Wow! This is messed up. It sounds like they knew each other from the story. The perp will probably claim he only meant to punch the guy and not cause him to fall into the train. Then he will plead it down to some lessor charge. He will be in prison a long time in any case. Hopefully!

I don't care what the gun laws are. To be in that kind of an area without one hand on the steering wheel and the other holding your handgun is just crazy. Had they started firing the instant they were attacked, they may have stood a chance at surviving. I have always said it is better to be tried by 12 than carried by 6.
