Response has really been all across the board. Those that are appreciative he 'got involved' to attempt to stop what appeared to be police abuse of the passenger. Those that don't disagree with what he did, but insisted he should have not made it his problem (that kind of drives me crazy personally... it's injustice, but you shouldn't do anything if you witness it???). Some seem to either hate or have severe mistrust of ALL law enforcement, and are hoping his case can invalidate police authority all together. Still, there are some who are ardent defenders of any and all action any LEO might take, no matter how blatantly unjust (police apologists). To my knowledge, no current LEOs have stood up and sided with my brother, but there have been a number of retired police officers who support him (and are frankly disappointed about the level of training they believe current LEOs are either not receiving or not internalizing. Most folks are just plain coming to the realization that every group has its bad apples, and are dismayed by the realization that a group such as the police, held in such high esteem, would have even a few of those bad apples.

The worst part of this whole situation, though, is that his basic rights are essentially suspended until this whole thing is resolved. He cannot carry a firearm for protection as he has been charged with a felony. If the chief of police down there would do the right thing, and discipline his officers and have the charges dropped, my brother would be able to get on with his life.

...or, by stating his opinion in the form of a rhetorical question...he gives others who may be eager to...the opportunity to be part of the answer to your question...I find his take on the situation to be very plausible and likely...based on experience...do you have an opinion or contribution on the OP or did you just pop in over 90 days later to criticize???(and to criticize a post made nine days before you were even a member. at that???)

Here's an update guys. My brother's case still has not gotten to the Grand Jury, keeping justice denied. Antonio did file a complaint with Internal Affairs (Police Monitor's Office), but the police investigating "found that no policy was broken". From there, he appealed to the Citizen's Review Panel (which has no power to really do anything). If his case is not "no-billed" out of the Grand Jury (whenever that is), he will be requesting a trial by jury.

Update: Antonio Buehler no-billed on felony harassment of a public official charges. Officer P. Oborski no-billed on tampering with governmental records (lying on a police report) and official oppression charges. Not really a surprise though. They would never indict the cop, and there was clear evidence that Antonio did not commit anything close to what was claimed. I can say this though: I guarantee that Antonio will fight the misdemeanor charges. I still don't get how a bully cop can be so clearly caught in his lies, and not face any punishment.

Hmmm. Spitting in the face of a police officer. No witnesses other than the officers and people involved. Video would not show spitting since difficult to see on video.

Photographing the police officers arresting a "party girl" when confronted by police officer. Hmmm.

Near as I can tell no other charges.

Hmmm.

Should officer be required to remove spit with a clean cloth and preserve for DNA testing?

The important mistake made here is the West Point grad did not call 911.
Anytime one feels an officer is doing something wrong the appropriate thing to do is
call the police and keep the dispatcher on the phone. All is recorded, the cop in question knows it (once you tell him)
and will understand the situation has then reached outside all involved on scene. You'll almost certainly get a shift supervisor on scene quickly.

I think it was foolish to confront the officers personally. Let police supervisors do the confrontation.
I would have video taped the incident and when the police officer came to me asking about the video I would have stated I have a 911 dispatcher on the phone listening right now.

What an idiot. If he had an issue, he should have documented it from a distance, then report it to the police department. Don't try and think you're going to be a hero and stop cops from doing their job because you think you know best. Passive resistance still requires force to affect an arrest. While to an observer, it might look like the person is just standing there, the cops still have to get that person down and restrained. I hope this guy gets hit with interfering.

I have seen this guy on various blogs and postings like the Statesman and other local media venues. He is always bashing on the cops for anything they do. Glad to see he is being charged. Film all you want, but don't interfere :nono: . Heck he would fit right in on some of these threads...

I thought he was a member here and just didn't post much? Or maybe I'm thinking of someone else.

I had that happen, Once. He became extremely compliant by the time we had made the trip to the jail. :evil2:
