Well an MP5 A5 is both a .22lr and an MP5

But really, ya think it's a coincidence that this guy bought and carried on the street a inexpensive version of the MP5? ..

I guess I'll be one of the few who think that the officer overstepped the law. He was very professional and polite about it though, I'll give him that much.

I don't believe that just carrying something that looks like it might be illegal is grounds to stop, detain and search. What if he had been carrying a Glock 17? It looks a lot like a Glock 18. Would the officer had then been justified to stop, detain and search?

Yup, as long as he can articulate to a jury, there is a good chance they would find it reasonable.

Unless your position is the LEO is lying in that vid, he stated there had been complaints made ..ie reason to go have a look.... and then his own personal observations that indeed the weapon in question did visually resemble a weapon that required specific and additional requirements above a semi auto unloaded weapon.

Really? So if they passed a law that made booze illegal, and the guy was carrying a flask, the officer wouldn't have grounds to stop him and ask him what was in the flask?

The officer never searched the guy. The word search implies that you can't see something but you're looking for it. The weapon was plainly visible.

He was open carrying a pistol. It is legal to open carry a pistol.

It was a scary looking pistol. Boo hoo. It should not be his problem that people are uncomfortable because he's doing a perfectly legal activity.

He wasn't searched? I guess having to surrender his pistol to the officer for inspection isn't a search. "Papers please".

Opinions like this are why LEOs often feel they can't win when interacting with the public.

He didn't surrender his pistol to the officer. The officer asked to verify that it wasn't an automatic, and he complied with the request. As soon as the officer confirmed that it was a sem-automatic, he returned the weapon to its owner.

When an officer pulls you over and asks for your license, are you surrendering your license? Do you think that is an unreasonable search?

it wasn't a pistol. it was a semi-automatic .22 LR version of an MP5 carbine

Unfortunately there are many videos posted by this individual doing the same thing in different towns all over Oregon. Sure it's legal to wear a gorilla mask around town, but it doesn't mean you have to. Cramming your ideals down the throat of the soccer mom driving down the street won't make her understand the reasoning or purpose behind carrying around a firearm in that way.


Seriously it does make gun owners seem ignorant. Especially after watching a few videos where he says wrong information several times to the officer he's speaking to.

Now, that's what I call professionalism....even inviting them to the Citizens Academy and Reserve.
