ABC Nightline about Joe Horn

Anyone else catch this Thursday evening's ABC Nightline episode? Covered Joe Horn and another man in Texas that shot a BG trying to get into his house. Interesting parting comment by the last guy when asked something to the effect of "what are the job hazards of being a burglar in Texas?" , "Death".

So should the penalty be.

These are not innocents accused by false testimony. These are evil men shot while committing their crimes.

There is NO reason to question their innocence.

There is NO reason to question their guilt.

There is only the question of why more of them don't wind up at the graveyard.

At one point, the assist. district atty says that there is no law that allows one to protect property with deadly force. If my memory serves me correctly, he's wrong here.
I think Joe Horn was able to sidestep charges based on that portion of the law.
(ONe of the legal eagles correct me if I'm wrong here.)

Damon Barrone was a rather easy case, IMO. His house; burglar obviously entering. I don't think there was ever a question over that one.

Now that scary to think an ADA doesn't know about TPC §§9.42 and 9.42!

I saw the same show...I thought that the DA was an idiot. He's from Harris County...so watch out for that fool! He mentioned something about having to "have your neighbors permission" to shoot.... (kinda the Joe Horn thing) and I have never heard such idiocy. I thought I was fairly versed in the law, so if I'm missing something, please enlighten me...

Also, perhaps a few of us should send the DA some e-mail!!! :cool:

I can't see that video...Who was the ADA that said this??? Hope it wasn't someone thinking about running for Harris County DA...

The asst DA's name was Warren Diepraam.

He doesn't appear to be running for office.

As I heard Diepraam's comments, I thought what planet is he from? :headscratch He sounds like Chuck "interpret the law as you see fit" Rosenthal, Diepraam needs to go to some place other than Harris County where his line of thinking would be appreciated. Preferably out of Texas. ;-)

Grand Jury has not made it's decision, I can't imagine having this hang over your head for this length of time. Usually, these things go to GJ fairly quickly but this is dragging along for way too long for Joe Horn.

I believe almost anything that comes out of Harris County. One former assistant DA believes it's not a criminal action for police to retaliate against witnesses by entering their home without a warrant, seizing their camera, destroying their film, and arresting them.
