I was put on new medication a while back and made the mistake of having a glas of wine about 8 hours after taking the pill. I got behind the wheel and all was well. Then I blacked out. I'm sure the Lord was with me because I was able to get off the road. I then woke up handcuffed. Please friends, believe me, there was no malice oforthought. However this is no excuse. I was temporarily intoxicated although not purposely. I'm not here to cry and wine. I pled guilty to DWI and got one year probation. I was given one year deferred probation for illegally carry of a weapon since I was in the state I was in. So...friends, now I'm on probation with 4 years and over 100 days to go till I re-apply for a CHL. I deserve this and I'll take it like a man. My questions are these: while on probation can I carry in my vehicle while traveling like non CHL holders?
Am I still allowed to own guns? These were class A and B misdemeanors with no assault charges or anything else. I have yet to meet with my parole officer yet and I'm afraid to ask the question. If anyone knows for sure...I sure would like to know.

Due to the fact that I have shamed myself and my brother and sister CHL holders, I will not make comment on anything except this issue. I ask for your forgiveness and the Lord's forgiveness.

Pastor1 - Sorry to hear about your troubles. Each probation is different, so there is no set answer that will cover all of your questions. I am going to quess that, since one of your convictions involved a handgun, as part of your probation you can't carry or own guns. If you have a lawyer he should give you a copy of the conditions of your probation. Of course, your probation officer will be able to tell you also. Everyone makes mistakes - how you learn from them is the important thing. Best of luck to you.

I am not a lawyer, but, since these were misdemeanor offenses, your right to keep and bear arms will not be impacted.

Regarding car carry, here is what the penal code says,

(a-1) A person commits an offense if the person intentionally, knowingly,
or recklessly carries on or about his or her person a handgun in a
motor vehicle that is owned by the person or under the person's
control at any time in which:
(1) the handgun is in plain view; or
(2) the person is:
(A) engaged in criminal activity, other than a Class C misdemeanor
that is a violation of a law or ordinance regulating traffic;
(B) prohibited by law from possessing a firearm; or
(C) a member of a criminal street gang, as defined by Section
71.01.

Since a misdemeanor does not prohibit you by law from owning a gun (unless it is a domestic violence misdemeanor, which this, obviously, is not), I see no reason why you cannot carry in your vehicle legally, as it says nothing about being under probation. But again, I am not a lawyer.

And, as I am sure Jesus would say, "I forgive you, and your Heavenly Father forgives you. Go forth and sin no more."

WildBill beat me to a reply, and I cannot refute what he said, as I have no experience with the Probationary system, other than a probation officer having my cell number attached to a "missing" probationer whom I have never met! Once again, I am not a lawyer!

Of course Christ has forgiven you, but it is well and good that you have a repentant heart about it. I'm sorry for your troubles.

HE WHO IS WITHOUT SIN MAY CAST THE FIRST STONE. With that being said, we all make mistakes. We are human and born with original sin. You are truly forgiven if you are truly sorry. And I can bet that the majority of us feel you are truly sorry. Do NOT beat yourself up over it. It happened its in the past. Like they said above talk to your lawyer. If your lawyer is unable to assist you I suggest getting a new one. One that is familiar with gun laws. Take this experience and learn from (I feel you already have). It was a mistake be thankful that you nor anyone else was hurt. Resilience is important in life. I will keep you in my thoughts and prayers as I am sure others will too. Keep your head held high and put it behind you.
