Aka...thats criminal mischief..and at night...pretty much fair game in TX
However if you shoot before Id'ing your target or possible threat..then much much bad stuff will be coming down the pike for you

well... I wasnt there, but how do you not realize your house is being TP'd? The kid is lucky he wasnt using slugs haha.
my opinion: Kids = Idiots
Homeowner = Gun Happy
Myself, I would have investigated alittle more before loading the kid up with bird or buck shot

If the guy was inside, wouldn't he have looked out a window before charging outside? I know I would have. Surely he would have seen the white streams of TP flying. The kids were dumb, no doubt, but this seems like an over-zealous shoot from the surface.

When my boys were growing up they warned their friends that "tromping around" in my yard at night would not be a good idea even if papering the trees was all they intended to do.

I am w/ anygun. All my neighbors know that TP wrapping my house will be treated like vandalism in the night. No I would not shoot them but neither will I let them off w/ a visit from the Sheriff telling them "now, yall go somewhere else to do your pranks & dont bother him again."

To add a little perspective to the folks who believe the guy was trigger happy...
I was once young and participated in a few house toilet-paperings. Some kids do much more than simply toilet paper the house/trees. Lots of kids get into actual vandalism, climb fences and onto porches, spread stuff all over the windows, etc. This kid could have been doing more than simple toilet-papering when he got shot. I can imagine many situations where a homeowner could shoot a kid on his property fully believing he is a burglar, without a toilet paper prank being evident.
Seriously, I can't imagine anyone of sound mind seriously considering shooting a kid for toilet-papering his house. It seems to me that there is probably more to the story than we have been told or likely will ever find out.

Police say three shots were fired from a 12-gauge shotgun, striking the 14-year-old in the chest, stomach and leg. He is recovering at a local hospital.
I just can't imagine being shot three times with a 12-gauge shotgun and recover from it!
It did not give us any idea of how close he was, but still, he must have been one big, strong kid. Maybe that was what scared the home owner.
Oh well, I guess we will never know the whole story.

Yes, but the story goes that the kids were there to TP the house, not to vandalize it in any of the ways you described. Although TP technically is vandalism, I think most folks know the line between "real" vandalism and plain ol' TP. I believe the sherif who made the statement said TP and not vandalism for a reason, but who knows.

The article doesn't say he was shot three times. It says "three shots were fired", and the kid was struck in the chest, stomach, and leg. It could have been a single #12 pellet in each location for all we know.
