Updated: Homeowner claims self defense in deadly shooting

PHOENIX -- A homeowner involved in a deadly shooting is claiming self defense.
Police: Homeowner felt threatened It happened early Friday morning near 34th Avenue and Bethany Home Road.
Police said the homeowner, who has some physical disabilities, invited two people over.
After talking to one of the visitors for about 30 minutes, some kind of argument ensued.
The homeowner said that's when the visitor threatened him.
"He is claiming that the victim in this case came at him with an aluminum baseball bat," said Sgt. Eric Lummley of the Phoenix Police Department.
The homeowner fired a single shot. The victim died on the scene.
At this point, police do not believe charges will be filed.

An aluminum baseball bat easily constitutes a deadly weapon particularly if used against someone who is disabled.

ANY baseball bat constitutes a deadly weapon against anyone, even those little souvenir bats you get at the ball park.

The first time you're hit with something hard you'll easily say it's a deadly weapon, if someone came at me with a gun I KNEW was unloaded or unable to shoot, that would still be deadly, because they just happen to be very hard objects which hurt. It sounds right now as if the guy was in the right.

I got some more info via a relative of the gentleman that was attacked.
Two guys were doing work for the gentleman, who has had colon cancer and has a colostomy. He also has active lung cancer, for which he receives chemotherapy, so he's got a few disabilities. The relative said he doesn't even know that the guy drives anymore.
Apparently the two guys had been doing some work for him and thought they saw an easy mark since he was disabled. T hey came by in the middle of the night (1 am, tghe relative thinks). Not sure about the "invited" thing listed in the article, but they show up. One of the guys goes around to the back yard, and starts stealing stuff out of the back. The neighbor that lives behind the gentleman told the police that he saw this guy doing this.
The first guy stayed inside with the victim. Since the gentleman knew these guys, he was apparently not expecting anything to happen. This guy has a baseball bat with him, and starts demanding that he open his safe and give him what's in it. The gentleman apparently decided that his odds against a baseball bat weren't good if he complied. so there was a scuffle, and he ended up shooting the guy.
That is story that I have, and but no other info.

If that story is accurate, the gentleman deserves a medal for exemplary exsanguination assistance.
