if i have a friend that has a felony conviction would i be breaking any laws if i was riding in a car with him while carrying my ccw (with permit )
does it make a difference if it is my car or his. i am sure it would be against the law to leave him alone in the car with the gun in the glovebox or console as this would be a felon in posession of a firearm.any and all information would be helpfull as i dont want to get me or my friend in trouble

You would not be breaking any law for carrying on your person in a car with a felon. He might be in violation of his parole/probation terms, but it would depend on the exact terms he received. As a general rule, i don't think he would get into trouble either, but there is always that possibility.

I can't speak to the legalities of your question but I can tell you my momma (R.I.P.) always told me that I was known by the company I kept.

I know of nothing in the law that would make it illegal for you to be carrying while in the company of a felon.

I trust this is a long time friend or some kind of "silly" felony otherwise you wouldn't be associating with him/her anyway. Not that that matters for the purposes of the law, but just personal safety.

well my friends felony was over 25 years ago and he has not been a repeat offender.the friend in question is good people and has no desire to repeat the past.
we are good friends and so that is why i wanted to make sure i dont make a mistake to get either one of us in trouble.

your mom is correct in her advice,i dont make a habit of hanging around known thugs/muderers/bank robbers or the like, this is a good friend who made a mistake and moved on with his life.i to made mistakes in my life although mine were misdemeanors and i have not made another in 17 years and am thankfull that people learn to forgive and forget.

So you wouldn't associate with either of the two border patrol agents that were recently commuted? You know they are felons!

You can be a felon for touching the wrong plant. Don't be so quick to judge.

Yep...the felony wrap is at times over blown. I know a guy that had a felony conviction for using a credit card he found in a mall. He was 18 at the time. He is 45 now and has a family...four kids...and has never committed a crime since then. he is a church going, god fearing 100K per year pillar of the community. Nobody would ever figure he had ever committed a felony.

More examples that prove that the insistence that all felons be permanently barred from exercising their 2A RKBA is absurd.

Speaking of being quick to judge, I told you what my Momma taught me as I was growing up. But since it has been brought up, I am kinda' picky about who I associate with...isn't everybody?

Once you "pay your penalty" that should be enough. IMO - This attitude is one of the main reasons for high recidivism. For someone who is willing and wanting to change their life style, all of the odds are against them. If felons can't hang out around good people and get good jobs, then they will continue to hang around other felons and commit more felonies. Of course, I wouldn't hang around with most felons. They are more likely to bring someone down to their level of morality rather that themselves being brought up.

P.S. Felonies, by definition are serious crimes. If a felony is a "silly" felony, it shouldn't be a felony.

Yep...or how about the 18 year old HS senior who sleeps with the 16 year old HS junior, both willing participants, but the 18 year old get's charged with statutory rape and spends his/her life as a felon and registered sex offender?

Silly felonies do happen. More than most of us want to believe.

I know we're getting OT here, but I think being "somewhere in the middle" is a good plan here. That is, I don't want to see recently released felons to have their full rights restored, but then neither do I think they should last forever if they keep their nose clean.

In other words, after you've done your time, you have ## of years of restrictions. Once that time is up (and you've kept your nose clean), then the restrictions are lifted. I would think that the ## would be equal to the ## of years of a sentence you served would be about right.

Just a thought.

I've had the same question, and some of the same concerns, as my eldest brother is a convicted felon. He made some stupid decisions and ended up with a drug conviction, made into a felony by his "friends" who squeeled like the pigs they were. They walked, and because of the lies they told (the truth would have made it a Class A Misdemeanor), he took a federal felony rap. Anyway, he went balistic on my other brother a couple of years ago because they were riding together and there was a shotgun shell in the back seat of the pickup. I told him that I didn't think they could pin anything on him since he was not in control of the vehicle, and anything found in a vehicle is deemed to be "possessed" by the driver of the vehicle. He didn't believe me, at all, so I told him that was fine, and that he could not ride in my vehicle ever again, because I always have at least one weapon in the truck, usually two, and you never know when a round might fall out of the box or whatever. I wasn't going to allow myself to be cursed by my own brother because he is afraid (understandably), but unwilling to research the law prior to jumping to conclusions.

On another note, I seem to recall something in Texas law (don't quote me on this, IANAL, and it's been 4 years since cop school) about felons being allowed to have a weapon in their home....not outside the home, but IN THE HOUSE, for home defense after a period of time. Seems like it was five years after the completion of their sentence, but I can't remember. I will look into it.
