Montana Fires a Warning Shot over States' Rights

"It's a gun bill, but it's another way of demonstrating the sovereignty of the state of Montana," said Democratic Gov. Brian Schweitzer, who signed the bill.

"In a bill passed by the Legislature earlier this month, the state is asserting that guns manufactured in Montana and sold in Montana to people who intend to keep their weapons in Montana are exempt from federal gun registration, background check and dealer-licensing rules because no state lines are crossed."

I like it!

Not sure what chance it has of being enforced but I sure like the idea.

Good luck with this one. Legal precedent for a long time has been any sort of commerce has the potential to be "interstate" commerce, and therefore subject to federal law.

Makes me want to move to Montana. I'd love to see this inspiring kind of move happen here in our great state.

I think the key to this becoming law would be comparison to other deadly or potentially deadly things that the states, and not the federal government, regulate. Things that are just as portable as guns. But I don't really know of any examples. Fireworks? Certain chemicals?

I really wonder what that will mean e.g. in terms of sound suppressors. Does that now mean a sound suppressor manufactured in TX and used in TX will all of a sudden become legal? Can I make my own? ...

The TX bill has some very interesting paragraphs in explaining that e.g. a sheet of metal is not a "gun part" and therefore not regulated by the BATF.
