I've bought many firearms, but never sold any. I have one now that I'd like to sell. What do I need to do paperwork wise to sell it? I bought it from a sporting goods store and did the standard yellow form, so when I sell it do I need to have any paper work for it or to transfer it?

No paperwork is required as long as you're selling to a resident of the same state in which you reside.

You can not sell to a known felon or to someone that you know is not legally allowed to own a gun. Some prefer to verify ID with a Driver's License or CHL to be sure.

A person may sell a firearm to an unlicensed resident of his State, if he does not know or have reasonable cause to believe the person is prohibited from receiving or possessing firearms under Federal law. A person may loan or rent a firearm to a resident of any State for temporary use for lawful sporting purposes, if he does not know or have reasonable cause to believe the person is prohibited from receiving or possessing firearms under Federal law. A person may sell or transfer a firearm to a licensee in any State. However, a firearm other than a curio or relic may not be transferred interstate to a licensed collector.

Where do the yellow forms go? I mean, if I sell this weapon, somebody has my name and info assosiated with it's serial number in a file cabnet somewhere. If the person I sell it to ends up using it in an illegal maner or it's found at a crime scene (I know, 'what if' questions can go on forever) what protection do I have proving I no longer own the weapon and are no longer responsable for it's use?

You can write up a bill of sale and have them sign it if you want to CYA. Or just have it transferred via your local FFL then you are off the hook if the guy goes bonkers.

While no paper work is needed, most people fill out a simple bill of sale. Anything just from the basics to a little more. I use this form. As long as you have a paper trail to CYA then no need to worry.

You can sell it to a dealer. They're required to enter it into their books when they buy it from you and do a 4473 (yellow forms) when they sell it. You get less money but you get a paper trail if that's important for you.

Whoops, didn't even notice the count.

The safest way is to do the transfer of ownership via and FFL dealer. You pay some $20 and save yourself the trouble of selling to a felon or anyone who is not entitled to own guns. That is an Auto-background check. Now if you sell it to your farther or son or anyone else that you trust and know like yourself, then maybe paper trail is not needed.

So what does happen to the yellow form?

Shred or burn the yellow form.

The dealer is required to keep it for 20 years.

Should he go out of business, they are packed up and shipped to the BATFE.

I never try to avoid 4473s when they are required.

But I would walk away from any deal where the seller wanted to go through a dealer when it isn't required.

The gubbermint imposes enough restrictions on our gun rights. I get real put out when a fellow gun owner adds to the restrictions.
