So I get a call from DPS today "Hi this is **** from the CHL bureau call in regaurds to your CHL and the letter that you sent. We recieved your background information today..." (I hung up voicemail at that point and called DPS LOL) I sent a letter requesting a hearing they recieved on the third, looks like they sped up my background investigation.

Edit: Just got off the phone with the lady that called me my license will be printed by friday at the latest and will be sent out UPS she'll call me with the tracking number when she sends it out

Edit 2: Anyone that gets the letter it will take two weeks to print the license is being lied to if mine can be printed within 3 days of the background being completed. Just putting that out there

I used the letter that dicion posted in this thread and just edited it to meet my needs. She told me that I was never denied but it sure seemed to work for me if she's going to send it by Friday and call me when she sends it to give me the tracking number. Also she said she had the letter and a legislative action sheet on me in her box all in the same day my senator hasn't seem to done much except get me the default answer so I'm accrediting all of this to the letter I sent

AHA!

This is EXACTLY what I thought they'd do!
Their Lawyers KNOW that they'd lose in court, and so they choose to try to placate you instead!
Oh boy... this is EXCELLENT news!!!

I'm actually really excited!!!

I hope Charles' plan is ready to go soon... wait till DPS gets a few thousand of those letters delivered simultaneously.

I would send the letter today, but because my fp cards had missing information, I fear my "completed application" date was reset to June 30. Original receipt was April 27, so it took nearly 60 days before they processed the cards and found my error. It's my own fault for not triple checking :banghead:

Ouch geek! I was hoping they didn't get mad at me and send me a "detailed letter" after 100+ days when I sent them my letter :)

Yes, technically, if they requested more information, then you did not send a 'completed application' to them until they got it.

I'm in the same boat, so technically our timers were completely reset to 0 on that day.

Now, If I reach 90 days past this, then I will probably be sending a letter, if Charles hasn't implemented his plan yet.

So should I get my letter sent off or wait for what Mr Cotton is working on?

Personally, I would wait for Charles' plan.

If we one-off these, they won't fix the problem, they'll just move people to the front of the line to appease individuals...
That's great for individuals, but not so bueno for everyone, as they'll just push back everyone else more.

Even if everyone on this forum did it, that's still only a small amount of the people currently waiting on a CHL. Don't want to make them wait even longer, do we?

We need to compel them to FIX the problem for everyone... and Charles' plan will do just that, compel them to Fix it.

Greater Good > Individual Good
At least in my opinion :thumbs2:

That's what I was leaning to as well. I'm at the point I'd like to lay a foot up somewhere or drop the hammer or all the other analogies you can think of that sound like a butt kicking. :tiphat:

On the one hand - congratulations! :thewave I'm jealous!

OTOH - I am sure that your action caused DPS to expedite the printing and shipping. I'm not so sure it had an effect on the bg check, though - you were at, what, about 135 days. I haven't been watching postings from Brazoria County all that closely, but I searched and ran across one other from earlier this year that took about that same amount of time. The point being - there's no certainty that the request for a hearing caused the bg check to get sped up, so I'm in agreement on waiting on Charles' plan to come together. Tempting though it is, I don't think I'll be requesting a hearing (at least for six weeks or so!). If a few people here and there start requesting hearings, DPS can simply start sending out the 60 day letter again - that wouldn't do us any good at all.

With that said, I still think it's very valuable to let your voice be heard if you are past 90 days - call DPS, email your state reps. I do not accept the idea that this is "line jumping" - this is standing up for your rights. I'm an April applicant, I really hope that the February and March folks who applied before me are doing what they can to get the attention their applications deserve. (Not so much the May, June, or July applicants who applied after I did...... :evil2: Kidding.)

And.... back to the first hand: CONGRATULATIONS!! :anamatedbanana

Actually, the letter doesn't matter once you get past 90 days. The letter only allows them to extend it TO 90 days.
I wouldn't bother sending a request for a hearing before 90 days though, because you are not implicitly denied until day 90.

I agree, and I'm sure you understand, that a LOT of Chl applicants do not know the laws. The amount of people we have on this forum is Very small, compared to the total applicant numbers. Some of them out there simply do not know, and would not ever know, of the Hearing method to force the application process. It is those people that would be delayed even further by individuals one-offing requests.

I'm not saying not to do it, I'm just saying that I think it would be more beneficial to EVERY CHL Applicant in the Entire State to let Charles do his thing. I think we're both in agreement on that point :)
