Legislative Wish List 2010

I know it is a ways off, but I will go ahead and get it started. There wasn't a place for it so I put it here.

1. Removal of state sales tax on all firearms, ammunition, range fees, range memberships, firearm instructional classes, etc. There should not be a tax on the 2nd Amendment.

2. Campus carry

3. Employer parking lot storage

4. Range protection act - grandfathering ranges and automatic civil fines against any company or municipality that engages in petty law suits against the range in even a vague effort to run them out of business.

5. Law allowing previous criminal activity or convictions of the shot or dead person to be part of presentable evidence in grand jury hearing or trial of a person who claims to have shot someone in self defense. This could help out a lot and reveal probably why the [abbreviated profanity deleted.] got him self shot in the first place.

6. A severe, and I mean severe, civil penalty (that reaches across state lines) written into law for any newspaper, or other media, or political group who somehow gets hold of a list of CHL holders and makes it public.

7. A second tier CHL that, with additional training and qualification, that will allow a CHL holder to carry anywhere a police officer could when off duty.

8. Conversion of ALL toll roads back to public roads - Yep, I know that last one isn't CHL related, it is just a pet peeve of mine. I think so long as one single dollar of tax payer money was spent on a road project, it cannot be a toll road any longer than it takes to pay for it with a maximum pay of time of three years.

I would respectfully disagree. Texas does not have an income tax. I like that. We tax books, CDs and other forms of free expression (1st Amendment).

Very good idea. I don't know about the civil fines aspect, but there should be a law simply making it illegal in the first place.

I am not so sure about this one. There are folks who do turn their lives around and still end-up on the short-end of the stick. Don't get me wrong, I know there are just as many if not more that don't. I just have a problem with this as a blanket statement.

Agreed. But how do you make this law extend across state lines? The only alternative I see is simply suing them in their state.

Good idea. I would also see this as one that should and could be denied. Much more stringent requirements.

I have always felt that way. Not just in Texas, but everywhere. Toll roads are a prime example of government jamming it down our throats after making blatantly dishonest promises.

have you ever pondered the amount of money being raped , i mean raked in at every toll booth ,
every second of every minute of every day ?

That is not a tax on the Second Amendment but a tax on goods and services.

I would also respectfully disagree. You are not being taxed on your right to keep and bear arms. You're being taxed on merchandise you purchase for the expression of that right. If you were actually being taxed on the right itself, then payment would be in the form of an annual "2nd Amendment Fee" to the government, payable on the 15th of April, along with your federal tax return. By extension of your logic, we should pay no sales tax on books, magazines, or religious objects such as a crucifix on a necklace.

To start off with, my understanding is that the next legislation won't be until 2011 correct?

I wouldn't mind seeing legislation to allow CHL holders to carry at their workplace. I work in a mortgage office and with the way things are going now, who knows who will get mad at us because of a foreclosure and come in and start something. So in essence, I would like to see if proposed where a company's policy cannot prohibit a CHL holder from carrying at work.

A law defining what SCHOOL is - limiting it's meaning to PUBLIC SCHOOLS.


As for your suggestions - I agree with 2-8, but not #1 (for the same reasons other people have already mentioned).

I agree with #2 ~ #8 as well.

Let me add a couple...

#9 - as defined by TxFig
#10 - Start with enforcement of the laws already on the books regarding CHL processing time, but applying penalties when the processing time extends beyond the processing time window without justification.
#11 - Legislation prohibiting the activity of "blocking" a bill from making it to the floor for a vote (ie. parking lot & campus carry), based on partisan politics. This equates to abuse of power and position by the folks on the calendars committee.

I'm sure more will come to mind.

I would think this would only be allowed if the GG was aware of the BG's criminal past. I mean, unless the GG knew of the BG's propensity for violence I would think that the GG's actions would be defensible by the facts of this one incident. Can't a BG's criminal past can be used to determine a pattern of behavior? Sorry about the circles I'm writing in.

I hope this doesn't serve to spoil the fun, but the next TX legislative session is not until 2011, not 2010.

But in practice you will see police stations with signs prohibiting such. I have one at the constable office nearby my house (Harris County - near Cypresswood and Stuebner Airline).
