Plaxico Burress indictment

I really want this guy to go to jail for - if nothing else - being an idiot. But I can't come to terms with the ridiculous "laws" he is accused of breaking. What happened in NYC wouldn't even be a crime in Texas (except for the possible fact that he was in a 51% establishment? who knows for sure - it was a dance club apparently?)
This is what irks me ...
How do states like New York continue to get away with these kinds of draconian infringements on our Second Amendment rights?

(note: quote taken from second of two links above)Unfortunately for Burress, however, any justification and excuse for carrying the gun are irrelevant under New York law. If he possessed a loaded firearm outside of his home or place of business, he committed the crime. It is a bright line matter.
