I just finished eating dinner at a restaurant. I tried looking for a 51% sign near the bar area but could not find one for the life of me. The eating area was relatively close to the bar so I was wondering if it was ok for me to be sitting there. Never saw a sign, even looked around while on the way to the restroom!

I ended up just enjoying my meal and decided to stay armed.

What is the rule if there is no sign displayed...? Should I ask and risk getting thrown out?

As of 9.1.9, it is defensible if the business failed to have a proper 51% sign displayed. That does not mean that if you are discovered that you won't be arrested. It only means that if it gets to court that you have a defense that you will have to prove.

If it was a 51% established it would be printed on their liquor license, and it would say this:

SIGN = RED

or

SIGN = BLUE

Red means it's a 51% establishment, meaning no conceal carry. Blue meaning it's NOT a 51% establishment, and unless there's a 30.06 sign, then you're probably ok.

What does that mean exactly? Is the paper its written on blue/red? or is the writing blue/red? or does the license actually have the wording on there "sign=red" etc?

The liquor license itself, is printed in green if I remember correctly. In the body of the liquor license, in the middle, are the type written words in colors of either red or blue. The next time you are in a bar or restaurant that serves liquor, just ask to see the liquor license. It's a good learning experience.

There will actually be a line printed on the license that says "sign=red" or blue. The color of the license actually indicates the type of license (beer or liquor basically) and is irrelevant to us.

And Springfield, you were probably looking in the wrong place if you checked the bar area of the restaurant. TABC would issue one license to cover the whole premise and the 51% sign must be conspicuously posted by the doors (and as needed). If you did not see it when you went in, it probably wasn't there. If the place is big enough to have a bar area and a restaurant, it probably is not a 51% license also. As a good guide, go with the idea of what you think of going there for. If I think of going there to eat, it is probably not 51%. If I think of going there to drink, it probably is. If the eating includes a few drinks, it is still unlikely to be 51%. If the drinking includes dancing or a quick small snack, it probably is.

If you were eating dinner there, I seriously doubt you were in a 51% establishment.



Unless the drink prices were REALLY HIGH!
