I received my on-line packet today and I have my class scheduled for this Wednesday. I looked at the checklist and the first item states that I need to be a resident of Texas for 6 months prior to be eligible. Then it goes into a non-resident qualification. I searched the forum for an answer and found that a lot of folks are saying this was done away with… Not sure what is accurate now. I have a Texas Drivers License with my current address. DO I need to wait 5 more months? Moved here 1/1. Any help is appreciated and if someone could point me to where I can find the official citation.. Much appreciated.

Whilst I hate to hijack a thread I have a supplemental question that is sort of related.

Can you take the CHL class ahead of your 6 months or your 21st birthday and just not send it in for processing until you meet the requirements of age and/or residency?

I ask because my 20 year old daughter is thinking of immigrating to Texas and she will be 21 in June and neither 'limitation' was an issue with my wife and I.

Here is the requirement you requested...

GC §411.172. ELIGIBILITY. (a) A person is eligible for a license to carry a concealed handgun if the person:

(1) is a legal resident of this state for the six-month period preceding the date of application under this subchapter or is otherwise eligible for a license under Section 411.173(a);

§ 411.173. NONRESIDENT LICENSE. (a) The department by
rule shall establish a procedure for a person who meets the
eligibility requirements of this subchapter other than the
residency requirement established by Section 411.172(a)(1) to
obtain a license under this subchapter if the person is a legal
resident of another state or if the person relocates to this state
with the intent to establish residency in this state. The procedure
must include payment of a fee in an amount sufficient to recover the
average cost to the department of obtaining a criminal history
record check and investigation on a nonresident applicant. A
license issued in accordance with the procedure established under
this subsection:

Also found this from back in '03:
"Rapid CHL for New Texans (HB 1704)

An oversight in the prior CHL law required newcomers to establish residency for six months before applying for a CHL, leaving them defenseless for half a year (see "Eligibility" under Government Code 411.172). This was changed to allow immediate application by a person who relocates to Texas with the intent of establishing residency (confusingly added to "Nonresident License" under Government Code 411.173; the six-month requirement remains in 411.172 and would apply to a person who moves to Texas without intent to relocate)."

So if I read this correctly the best I can do is a Non-Resident CHL. Correct?

My guess is the part in red.

In your shoes I would go ahead and apply like normal and make sure to provide the work and residence address history.

Once you move to the State of Texas, establish an address and get a Texas Driver's License, you are immediately assumed to be a Texas resident for the purposes of getting a CHL. Our instructor covered this in my class, specifically.

I moved to Collin County on 12/5/09, got my drivers license a week later, took the CHL course on 12/19/09, and received my plastic approximately a month later.

If you have moved here, and have an accurate and valid address, and have gotten your texas drivers license (yes, even the little paper one), you are good to go! Trust me, I'm living proof.

I can verify, there is no longer a 6 month residence requirement. You have a Texas DL and a Texas residence address, and you are good to go. BTW, welcome to the forum!
