I will be at TMS this weekend for the INDY car race....I know can not carry into stands BUT what about Parking Lot & CAMPING AREA? WILL SECURE IN TRUCK LOCK BOX during race...I do have to travel 3 hours to get there & do not like to do so without a weapon.

I don't know, but I can tell you that I just did a gun trade in the parking lot of the Police trailer near 114 just a couple of weeks ago and saw no signs (or Police).

If the parking lot is not posted, you are good. If you are in an RV, that is your domicile.

POSSIBLE NEW TWIST....this time I've been invited to stay in the "INFIELD CAMPING AREA"..area is fenced and access is controlled ..I still know that i can not carry into the Stands or Garage area...BUT if it is kept in truck or camper AND parking lots and camping areas are not posted 30.06...I am still OK...Correct?

For both 46.03 and 46.035, "Premises" means a building or a portion of a building.

OK team...one more twist....to enter the infield Parking/Camping area you must either have a special arm band or INFIELD RACE TICKET....and many actually watch races from that area inside the Track Oval......COULD that be considered on "premises" of "professional sporting event" (PC46.035)....Please advise !...

I would say a field is not a building but I'm not your lawyer.

I wouldn't try to split hairs. It's on the premises of the racetrack. You can debate all day long whether or not the infield counts as a parking lot or premises. It's a third degree felony if you are caught and you are wrong.

I would venture to say this, the Infield is not a public or private driveway, street, sidewalk, or walkway, parking lot, parking garage, or other parking area. The entrance through either tunnel is posted with a 30.06 sign I believe, it is also noted on the back of the PI passes ( Pit , Infield ) that I get every race that you may be removed for cause, several of witch are listed, and fined $500.
When I took my CHL class last weekend, we were told that the definition of racetrack meant any place that a race of any sort was occurring. The instructor told of us an individual that is being prosecuted for carrying at the gokart track in Rhome.
For what it's worth, I would think that you could carry in the public access parking lot outside the facility. However, inside the facility, either in the stands or infield, you would be facing the following sections 46.035 subsection 2, and 46.03 subsection 4.

If I am wrong, I apologize, that's just how I read it. To me, entering the facility through either tunnel counts as entering the premises.

If it's not government property and it's posted with valid 30.06 signs, then it's off limits. No argument from me.

Was it a Texas CHL instructor or one of those trouble making New Jersey instructors?

The Texas Racing Act referenced in Texas Penal Code 46.01 clearly says:
"Racetrack" means a facility that is licensed under this Act for the conduct of pari-mutuel wagering on greyhound racing or horse racing.

Texas CHL Instructor, Ft. Worth LEO kind of guy. I asked the same question about the betting, and he reiterated his statement that for the purposes of this section the texas AG had stated that a racetrack is a place where racing occurs. Irrespective of cars, horses, dogs, and apparently go-karts.

I can envision claims that, due to the way TMS was constructed, the infield is actually part of the building.

Do you know which AG opinion? I can't find that ruling here but maybe I'm not using the right keywords.

In this case, I think IndyCar racing is probably a professional sport, so any "premises" would be off limits for that reason.
