minor in posssion with gun ?

a buddy is trying to get his CHL and he asked me for my opinion on this..
he's in his 40s, no criminal record other than:

at age 17 got pulled over, and taken into custody
charge was for "minor in possession of alcohol"
small town, parents called, paid a 50 fine and went home, that was the end of it

He got the certified record from the local PD and it says that there was a loaded 22 in the back of the vehicle
but there was no charge for that, the charge was just for minor in posession of alcohol, parents called, fine paid, end of it.

problem for him?

I kinda doubt it. As long as he wasn't charged with a violation in the eyes of the law there wasn't one.

I think MIP is a class C misd so a single conviction is not a CHL disqualifier.

I think he does have to list the arrest and disposition on his CHL application.

I think IANAL.

A good question would be, "What year did MIP become a crime?"

It wasn't always a crime, you know. Back in the dark ages when I was fifteen, I frequently went hunting by myself with a shotgun.

He's fine. The MIP is a Class C and if the .22 was a rifle, that wasn't illegal. Even if it was a handgun, he wasn't charged. If he had been, it would be a Class A and that is disqualifying only for 5 years.

thanks for confirming what I thought would be the case.
and it was a 22 he said
small town, had been out shooting in the country earlier that day

back then, we all had 22s or shotguns in our trucks, and on school property even!
