Great Example

Here at A&M College Station we received this Clery Act email today:

Crime Alert

Campus crime alerts and timely warnings to the community comply with the federal Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act (Clery Act).

On March 24, 2011, at approximately 8:00 AM, the Texas A&M University Police were dispatched to Parking Area 71B (across Agronomy Road from the Vet School) in reference to an aggravated assault.

The victim reported that on March 24, 2011, at approximately 6:15 AM, he parked his vehicle in PA 71B. As he was walking away, a male subject stopped the victim and asked if he could take his truck “for a spin”. When the victim said no, the suspect removed a steak knife from his right pocket. In response to the suspect’s actions, the victim attempted to defend himself. The suspect stepped back and then fled the scene on foot. He was last seen running northwest from PA 71B.

Description of the suspect is as follows:
• Black male
• Mid 20’s
• Approximately 6 feet tall, 180 pounds with a medium build
• Red Hoodie
• Black basketball shorts
• Nike shoes, unknown color
• Pierced left eyebrow

The victim was not injured during the encounter.

That is all the information available at this time.

I know technically my CHL and I think even the motorist law allows me to be carrying on my person (CHL) or in my vehicle (motorist) in that parking lot (as I independently but not officially verified personally with our police chief) but the fuzziness of it makes it difficult to say whether or not I would have been armed or if it would have already been locked up in my lock box. CHL's on campus would remove that doubt for me so if I was in this position, I'd be better equipped to defend myself should this type of scenario have happened to me.

...did he "attempt to defend himself" with a rolled-up copy of the student handbook??? Since they're not comfortable with students being armed...they should have had an armed guard on the lot...they want it both ways...hope that changes this year!!!

During an interview with Texas A&M University Police detectives, the victim of this alleged offense admitted that the crime did not occur.

Very interesting to make something like that up but seems like a real enough possibility to me!

I don't think one could be in that parking lot carrying without a CHL legally. Well, it's possible, but not very likely. The exceptions are probably few. I think, in order to legally carry away from your car, you must be going to and from your residence or place of business. Since this was a school parking lot, if the "victim" were going into any building on campus he would have been about to commit a crime whether he had a CHL or not. I don't know where this parking lot is, so I don't know if it is possible that the "victim" was parking there and going to some place just off campus, like an apartment or business.

What I meant, through a not very good choice of words on my part, was that the motorist law (whatever its officially called) would allow him to have the firearm in his vehicle and a CHL would cover both in his vehicle AND in the parking lot. Where he would be going from that parking lot would raise a different issue.
