Important Reminder

School board and city council elections are coming up. Don't forget to vote in your local elections. (Especially if you live in Stephenville.

) Deadline to register to vote in the May elections is April 14. To check your voter registration status, register to vote online, or request a ballot by mail, go to
http://www.votexas.org" onclick="window.open(this.href);return false; or stop by your county's tax assessor-collector. (While you're there, ask if they can give you a stack of registration forms and ballot-by-mail requests to drop off at a local nursing home, hospital, etc.)
Most cities have their ordinances online. Take advantage of that to search for things like "handgun" or "firearm" and see if your city has any ordinances that need to go away. You can gauge your council members' attitude towards 2A by how they respond to attempts to get anti-gun ordinances repealed.

Use and/or possession of firearms.
(a) Unlawful action.
(1) It shall be unlawful for any person to fire, shoot, explode or cause to be fired, shot or exploded, any firearm, rifle, shotgun, pistol, revolver, air rifle, air pistol, paintball gun, pellet gun, BB gun, crossbow or other similar device capable of propelling bullets, shot or other solid or compact substances, whether propelled by powder, fire, compressed air or other force or by a combination of such forces within the city limits.
(2) It shall be unlawful for any person to possess, display, or brandish any facsimile firearm or air rifle, air pistol, paintball gun, pellet gun, BB gun, crossbow or other similar device in a public place or in an occupied compartment of a motor vehicle within the city limits. For the purposes of this section, facsimile firearm shall mean any device that so closely appears to be a firearm in size, shape, color, or design that it can only be differentiated from a firearm through close inspection or is likely to cause alarm to the general public.
(b) Defenses. It is a defense to prosecution under this section that:
(1) The person was a law enforcement peace officer acting in the performance of his official duties;
(2) The person was at a shooting range or other recognized practice facility;
(3) The person was using blank cartridges for a show or theatrical production or for signal or ceremonial purposes in athletics or sports, or by military organization;
(4) The person was acting in self-defense or justifiable or excusable homicide situation; or,
(5) The person was using a device which is for the purpose of firing of stud cartridges, explosive rivets or similar industrial ammunition and such device was being used for its intended purpose.
I just found this for the city that I live in. How can the highlighted part be legal?

You think it should be legal to brandish a firearm in your vehicle?
Read the ordinance again...
It shall be unlawful for any person to possess, display, or brandish any facsimile firearm or air rifle, air pistol, paintball gun, pellet gun, BB gun, crossbow or other similar device in a public place or in an occupied compartment of a motor vehicle within the city limits.
In addition, that portion of the ordinance applies to airsoft or bb guns, not real firearms.

My mistake, I was hung up on the
possess part of it. I didn't get the part that it didn't include real firearms.
My bad.

Depends on your definition of "brandish." By the dictionary definition, I do it fairly often, though not where anyone outside the vehicle could see unless they're using night vision goggles.
Besides, the possession restriction also means that if you want to transport a pellet gun in a pickup, you'll have to toss it in the bed. I wouldn't even do that with my $40 Daisy, much less some of the $500+ competition-grade air rifles I've drooled over. There doesn't appear to be any legal way to carry one at all in a station wagon or SUV.
