CO: Convict sues state prison for reviving him

In Colorado, a prison inmate filed a federal lawsuit against the state for reviving him after he was clinically dead from sleep apnea. He had previously filed a do-not-resuscitate order. He also was suffering from various other illnesses and injuries.

The 54-year-old inmate was convicted of murder in 2003 and sentenced to life without parole. He claims innocence in the murder, but multiple appeals have failed.

It's not clear what he would do with any settlement from the lawsuit.

I'm not sure about CO, but from what I've been told by my wife (RN) and several paramedic friends I know, in TX, first responders are not liable for violating DNRs. It's their job to resuscitate and keep the person alive until they reach a hospital. I'm not sure if this would be applicable in a prison environment or not.

That rather long story said the same thing. Prison guards and first responders did not have access to the prisoner's medical records.

Hospital and nursing-home patients often have DNR orders displayed on wrist bands, but prisoners are not allowed to have wrist bands.

Hmmm...? Interesting question.

I don't plan on having the agony prolonged when it's check out time for the Oldgringo.

Maybe he is better off dead. Too much to ask? on next sleep, he just has to forget the oxygen mask. Then, the judge can dismiss the lawsuit.

Another good question! This could turn into a much more cardinal issue than the legality of the various CC signs, Lady Gaga, church carry, etc., etc.
