Hunting while carrying

If its on the internet i could not find it. What are the rules for carrying while hunting without a CHL? i looked on the TXPW site and the public hunting land site and only seeing where it says IF you have your chl while bow hunting its fine.

I dont have my chl yet unfortunately

If you're handgun hunting legally (in-season et cetera) there shouldn't be a problem.

If you have a CHL you can carry while hunting in any season, just dont use it to hunt with if its archery season or something like that.

I carry while deer hunting but I have CHL.

But you can:

Sec. 46.15. NONAPPLICABILITY.
(b) Section 46.02 does not apply to a person who:
(.....
(3) is engaging in lawful hunting, fishing, or other sporting activity on the immediate premises where the activity is conducted, or is en route between the premises and the actor's residence or motor vehicle, if the weapon is a type commonly used in the activity;

A handgun is not commonly used for bowhunting. ;-)

Hmmm I remember from my CHL class the guy saying that you could carry even in bow season as long as the dear didn't end up with and bullet holes in it. I will have to see if I can find where it said that. It possible that this was also something that my instructor just came up with, but if you are on your land or a lease why would you not be able to carry as long as you were not hunting with it?

On your property there should be no issues. However, on public land of course you cannot unless you hunt with it or you have a CHL. Not sure for hunt leases. I assume if you have legal lease and have access to the property, you have temp control of the property. Please someone clarity.

Ahh I didn't see that without in his question, guess I should look closer my bad. Then yes I agree without a CHL you can not carry during bow season.

I will be rifle hunting with a scoped rifle for whitetail on a public hunting land. like i said i looked on the land website and texas parks and says nothing either way EXCEPT for bow season you can carry it WITH a CHL if your bow hunting.

my dad will be carrying his 8" 44 redhawk. I just wanted to carry my glock 27 or hopefully by that time a glock 20 or 29. in case of hogs etc not to actually hunt with. Although i have read people that have been tracking a wounded deer using their pistols to finish the deer if it spooks etc I don't remember the exact reason.

I have a model 94 chambered in 44 to sort of eliminate both issues but i never know when my dad will want that over our 270. not to mention snakes etc.

im assuming without the chl it would have to be outside the waste., I may call texas state troopers and game wardens tomorrow to get an unofficial official answer ha ha.

Okay, a sidearm while hunting (not bow season with some exceptions) should be legal.. A handgun does not need to be the primary weapon in order to be "commonly used" in that event. Otherwise why would the statute include fishing. A side arm can be used for hunting as long as its not a rimfire (using a .22 for poaching in deer season).

However, during bow season you are only allowed to be in possession of a firearm if a CHL or...

So if you are not hunting deer during bow season, you are good. Even if you are, you can still have it in camp or in/on your rig.

I would also think that if you leased the property, that is property under your control, though I wouldn't have a bow and quiver full at the same time. My experience, FWIW, has always been when the warden came into camp to check licenses, coolers, etc.; there has never been so much as a mention of the side arms we were wearing (and we had a mean one). After all there are thiiiings in the woods beside deer.

Thats why i checked the website because if you go to the website for Lake Lavon it states clearly even with a CHL a gun is not permitted, there are some very minor exceptions to that rule for that lake.

I should have my CHL anyways but even that aside I know there is several places hunting/fishing is allowed but concealed handguns are not.

bonham state park is one of them last i checked

I hunt hogs and though using a 7mm rifle I carry a handgun with my CHL. These things can turn mean and easily charge you.

You can carry a scoped .30-06 rifle without a CHL but I wouldn't carry one into the woods when bowhunting during archery-only season.
