This may be covered somewhere but can't find it. So I will ask it here.

Just came back from Pappadeaux, took my wife to lunch.

We sat in a booth just opposite the bar. Restaurant was crowded and that was the only booth.

The restaurant does not have any signs whatsoever but I turned around
and put my gun in the car.

The bar area has stools around the bar. We were not seated there but no more than 6 feet from the bar.
I did not feel comfortable carrying in that situation.

What do you all say? Is it legal or not to sit there?

Secondly, suppose I wanted to have a beer with my lunch. While carrying is consumption of
one beer legal? I was told that if a situation comes about where I had to use my gun any alcohol
level is considered a No No.

I have never drank any alcohol at all while I was out with my gun. I have not been carrying that long,
two months, but I have always wondered about that.

So long as there is not a 51% sign or a 30.06 sign you are good to carry.

it is legal to carry there, and at the bar at outback and at any other restaurant that does not make 51% of its business via sales of alcohol for on premise consumption.

Basically if it is a restaurant first, and has a bar, you should be legal, just watch for either the BLUE sign or the RED sign.

TABC say Pappadeaux is under a blue gun sign so carry on and some where there should be a sign. Took me a while at Hut's in Austin to find one. I checked ahead of going so I knew it was OK.

Alcohol & guns don't mix, have a nice glass of iced tea. I made a choice to carry so its nonalcoholic drinks when eating out.

Totally legal. If there is no 30.06 sign posted, it depends on whether they derive more or less than 51% of their income from the sale of alcohol for on-premises consumption. The bar is not off limits to you, but being intoxicated is. So, carry your gun, enjoy dinner, avoid alcohol, and have a good time.

I worked for the company for almost 4 years. It's not 51% nor is any other restaurant.

That's a choice you're going to have to make unless you give up alcohol (and many prescription medicines) completely. If you have a beer at home, do you unload all your firearms and lock them in a safe? The same principles apply.

Don't mix them order a soft drink with your meal or an iced tea

Proximity to the bar makes no difference.

I guess I am in the minority here. At least once a month, we go out for a fix of Tex Mex. Keeps the old system functioning. I always have one Corona, or original Coors if in Colorado. Am I the driver? Of course. Am I carrying? Of course.

Someone correct me if I am wrong (actually, even w/o saying that someone would!).... but even if a bar fails to display the 51% sign as they should, it is you the CHL holder who has the responsibility of not going. Unlike 30.06, which is business optional, actual bars are an auto no-go for CHL holders. Always check the liquor license on their wall.

It is a defense to prosecution if the TABC licensee fails in their duty to post the required signs. Make of that what you will.

I've never carried and drank. Average consumption may be 1 beer every three months and that might have been used in cooking. Is one beer going to turn a person into a mad dog killer. I hope not, but as I said I've always respected the rule.
