Need Your Help Defending Gun Rights in New Mexico

In a nutshell, the Mayor of Ruidoso, a town heavily dependent on tourist dollars, has banned firearms from all public property. This is in clear violation of the constitutional preemption NM has.

He claims state law makes him a peace officer and another statute allows him to take guns from people using public property under a permit, and therefore he can do whatever he wants.

Please call him at (575) 258-4343 and tell him you won't be visiting Ruidoso unless he quits it with this illegal and unethical behavior (politely or not, he deserves whatever you want to give him). Feel free to tell him to pound sand while you're at it :)

Will do. But better yet, I might have access through a friend of mine to the governor of New Mexico. Let me check and see what I can do.

In cases like this, it is usually a good call to the NM Attorney General asking them to step in and overrule the misinterpretation of state and federal laws. And, calls/letters to the governors office are also important.

I've been to Ruidoso and saw no resaon then to return. It sounds to me like the mayor's electorate and/or city council should set him straight...unless they agree with him?

This is unfortunate. I hope the situation is rectified soon as I was hoping to visit this place soon for the ski season.

I'm on the phone with my friend in NM at this very moment, and she says that the NM AG is a total crook who will do exactly nothing. He's a liberal democrat, and not much of a 2nd Amendment supporter.

I wish she woudl tell you how she REALLY feels about him. :lol:

Unfortunately, that really stinks. Best bet is the Governor's office now. Now sure how Gov. Martinez is on 2A rights, but if enough folks call in, it ought to get their attention.

In that case, find a 2A-friendly judge who is willing to issue a writ of mandamus.

The description will explain:
A writ of mandamus or mandamus (which means "we command" in Latin), or sometimes mandate, is the name of one of the prerogative writs in the common law, and is "issued by a superior court to compel a lower court or a government officer to perform mandatory or purely ministerial duties correctly".

Mandamus is a judicial remedy which is in the form of an order from a superior court to any government subordinate court, corporation or public authority to do or forbear from doing some specific act which that body is obliged under law to do or refrain from doing, as the case may be, and which is in the nature of public duty and in certain cases of a statutory duty. It cannot be issued to compel an authority to do something against statutory provision.

Mandamus may be a command to do an administrative action or not to take a particular action, and it is supplemented by legal rights. In the American legal system it must be a judicially enforceable and legally protected right before one suffering a grievance can ask for a mandamus. A person can be said to be aggrieved only when he is denied a legal right by someone who has a legal duty to do something and abstains from doing it.

The governor has a CHL and recently completed her 2-year requal, and then shot a bunch of steel targets for the press (and to help her instructor/police chief friend drum up more business). She takes the program pretty seriously.

My family and I make a minimum of 6 (usually more) trips to Ruidoso every year for a quick get away. We really like the town, but are not planning any further trips until the intent of this issue gets resolved.

Haven't crooks been the SOP in NM for some time now?

Update: Verbal shots fired in Ruidoso gunfight
RUIDOSO, N.M. (KRQE) - There were powerful emotions and strong words at a city council meeting in Ruidoso, New Mexico Tuesday tonight.

Gun owners from down the road and from around the country, packed council chambers to give the mayor an earful about his executive order banning guns from village government buildings and meetings. They ignored the ban to prove their point. Guns were very visible but the only shots fired were verbal and they were directed at the mayor. "You are just as a much a tyrant for requiring someone to surrender their civil rights to carry a firearm in order to participate in their government as you are in asking them to surrender their right to vote or anything else,” Bob Wright said.

Speakers were given three minutes to speak and they did not hold back ,most of them with their guns holstered by their sides. "Almost all of the mass murders in our country have occurred in areas just like you're fixing to set up, in gun free zones,” Executive Director of Gun Owners of America, Larry Pratt, said. Locals, activists from the NRA and the Executive Director of Gun Owners of America, who flew in from Virginia, took to the podium to take a stand.

In all more than 100 people filled the council chamber to capacity, dozens of them carrying guns, despite signs that say ‘no guns allowed.’
Good for them for standing up to this nimrod.
