I got a ticket for 95 in a 40, What class misdemeaner is that?

Most "speeding tickets" are class C misdemeanors..... Assuming you wern't arrested I would think this one is too...Some enhancements to the fine might jump it up like school zones and construction etc. Racing I think is the Felony charge also possibly reckless driving or endangerment but I would think you would have been arrested and charged on the spot.

Look at the back of the ticket....might just have a fine scale there as well. You can call the court and ask as well.

You can go to court and ask for defered adjudication if your record is clean...plenty of speeding ticket lawyers out there

What was the final adjudication?

Just because you got a ticket does not make that the final disposition....

If you are asking what level offense it is to BEGIN with, I believe that 55 over the limit in Texas is handled similarly to any other violation....

Assuming you were guilty of ONLY the speeding offense, no injuries, no driving without a license or insurance, I BELIEVE it's only a violation.
You should check with an attorney, but I don't believe this would impact CHL eligibility.

Luckily you were not OVER 95... You should still be able to take defensive driving.

If they just charged you as speeding, then the offense is a class C misdemeanor punishable by a minimum fine of $31 and a maximum fine of $230. In addition to the fine, there is a court cost charge involved that usually totals around $107 right now (I think). Many tickets for speeding have a formula of so much per mile over and do not mention the maximum, but the law does cap it.

I am surprised that the ticket was just for speeding though. Most officers would probably have used a speed that high over the limit as grounds for a reckless driving charge, which is a class B misdemeanor (that means jail time).

First off, if you were doing 95 in a 40, then you should have your license pulled. Sorry, but I lost some very dear friends to someone who was driving 98 in a 40 and ran red light, went airborne when they hit the curb and sheared the top off of the minivan the family was driving. It killed all 5 of them. The individual ended up paralyzed and is now spending 15 years in prison for vehicular manslaughter. You need to think about that for awhile.

However, if it was just a speeding ticket, then it is a class C misdemeanor. If they charged you with any other violations, like negligent driving, etc, then there could be higher levels of penalties.

There is literally no justification for driving 95 in a 40 mph zone, other than pure unadulterated stupidity. If it is even close to having been a recently acquired ticket (like in the last year or so), that would be a pretty sure sign that you might not be mature enough for the responsibilities associated with carrying a firearm. Maybe CHL is something you should put on the back burner until you've burned off that excess testosterone.

Thats kinda what I was thinking. It's good you want a CHL, but I think you need to learn to protect yourself from yourself first. I don't mean to sound harsh, but a CHL is for reasonable people. 95 in any speed limit is not reasonable.

I really think the OP should not get a CHL...He has a lot of growing up to do. Doing 95 in a 40 is reckless and will kill innocent people. I think he is a troll.
