Hi everyone,

What are the rules and regulations in Texas for the private sells of used firearms at gun shows from private owner to private owner?

Do you ask the buyer for their driver license or sign any documents?

I got some used firearms wanting to sell at the upcoming gun show and wondering what is the proper procedure of doing this.

Any tips or suggestions would be greatly appreciated.

Exchange guns for money. That is all that is legally required.

I looked up all the laws a while back and read them when I was selling a few firearms, and basically what llwatson said is right on. Use your best judgement. From what I can remember, if you can reasonably assume the fellow is a) a US resident, b) not intoxicated in any way, and c) doesn't seem to have any ill intent for the use of the firearm then you should be good to go. No paper transaction is neccessary, but if you want one for your own records go right ahead.

The responses you received so far are correct. There is no record-keeping requirement for private sales. You may want to keep a record for yourself, but that's up to you.

However, you said you have some firearms to sell, so be careful you don't violate federal law by dealing in firearms without an FFL. The Catch 22 for BATFE is that there is no definition how many sales constitute dealing in firearms. Is it two, three, twelve, who knows? I would be reluctant to sell multiple firearms at any one time, but that’s just my opinion.

Your question is ironic in view of the recent filing of HB594 by Yvonne Davis seeking to extend background search requirements to private sales at gun shows.

I just have only a couple of guns which I want to sell at the gun shows that's all. I think it's better to sell it at the gun shows rather than posting an ad on the newspaper and strangers come into your house to look at your gun. You can't be too careful these days.

If you don't have any luck at the show you might want to post them for sale here in the "Market" section.

I can't imagine you'd have a problem with just two guns. My earlier post should have included a reference to HB 595 that would add a tremendous amount of paperwork to selling guns. There is a separate post on that topic. but don't worry too much; it's not going to pass.
