Ok let me start off by telling you all that I own a lawn and landscape company. So here goes..
I recived a phone call from a national company today that provides lawn care and custodial services for many company's. All they do is get the contract then sub contract out the work. So anyways I go and look at the property ion question and we discuss over the phone and reach a basic agreement. He then asks for my email so he can email me some forms to fill out and return. Well there was a form for a back ground check,payment details and a "sub contractor code of conduct". This is where the problem comes in...

4) No concealed or unconcealed firearms are allowed on job site or grounds.

So I don't like that one bit so I emailed him back that I'd have to decline because I firmly support or admendments and esp our 2nd!!

He replies with " I'm an avid hunter and understand our point, somewhat. All we ask you to do is not carry a weapon on your person while on our site. We do not care how you came or what is left in your truck".

Um ok. Lol. I know concealed means concealed but I assume that was a formal notice. So my question is..what would you have done?

Ps: I'm extremely happy with my current bussiness and I'm picky on what we pick up now. So the loss of this small $$ does not affect me.

Tell them that the entire idea of unarmed is out of the question. They can remove it from the contract or they can get some other schmuck!

I agree with the sentiment, but as a self-employed person myself, it is never good to use language that will burn bridges. I think I might counter with something like:

• Dear Bob (or whatever his name is),
  
  I understand that your company has a written and non-negotiable policy against the lawful carry of a licensed concealed handgun on company property that I would be required to sign before I could enter the job site. Is X Corporation prepared to guarantee my personal safety at all times while I am on your site, and will the corporation agree to assume all liabilities incurred if that guarantee fails? If so, then I am prepared to start tomorrow. If not, then I must respectfully decline your generous offer. Perhaps in the future we will be able to do some business together when the corporate culture has changed for the better.

If it were me, I might change up the contract (ie - send a contract of my *own* back to them for their initials....):

Good for you. You stuck a small blow for freedom, and even though you and I don't know each other, I am proud of you. You did good by your fellow CHLers.

I recently had a similar exchange with the manager of a gun show who prohibits concealed carry. After a few emails he got my point--but not my business.

Hold your ground and press on...

Thanks for relating this story. I appreciate your candor with a potential business associate. Unfortunately, that seems to be a more rare quality these days, so bravo!

Morals before money in my mind.

I was once asked to maintain an abortion clinic-declined
I was once asked to landscape an adult video store-declined

Funny thing is that a guy I met and told about the adult video store ended up buying years later just to tear it down!! Then we maintained the empty lot until the land was sold!!

I have signed many contracts over the years where I simply lined out clauses that I did not agree with and initialed by change. Sometimes the other party signs without comment, sometimes they counter with other alternate language.

Bottom line for any and all contracts is you must know what items you consider to be negotiable and what items you are not willing to negotiate.

In the above instance, I wouldn't have even discussed it with him. I would have simply lined out that clause and initialed in the margin. Signed the contract and returned it. They would take it or they wouldn't.
