Penalty’s for violating state preemption laws?

Maybe Charles can answer this question.
Are there any plans to introduce a bill this upcoming term creating penalty’s for municipality’s violating state preemption laws?

I am interested in Charles' reply.

I would think that passing such a law would be difficult and a waste of time.

Good question and I am sure we all would like to know. Sure ticks me off that Plano ISD posts illegal signs on all of their school driveways. They know it is illegal but they refuse to remove them.

They passed a law but have any violators been successfully prosecuted?

Good question. I haven't heard, but did read about a flurry of activity in various municipalities to get those laws off their books.

I don't know of any law that they are violating. The signage that PISD has up may not comply with the law, but they are not illegal, and they have been made aware that the signs are not enforceable, but they intend to attempt to enforce them anyway.

Just curious, but where did you find the information that Plano ISD would attempt to enforce them anyway? That seems to conflict with the letter that Zoti posted on 9/21/2012 from Plano ISD.

I do remember reading that Grapevine PD would try to enforce the non-compliant signs at Grapevine Mills. Perhaps this is the one you were thinking of?

Probably yes. I've already written the bill and it is in the hands of a sponsor. It creates an offense for posting unenforceable signs and does several other things no elected official or government employee will like. :biggrinjester:

I don't know if anyone has been prosecuted under Florida's new law, because unenforceable signs started coming down in batches when the law passed! I doubt there's anyone to prosecute.

Thank You Charles. With all the stories you hear about the DAL and SAT airport terminals ( aarrest and let the DA drop the charges after you spend your time and money) I dont want a beat the rap but not the ride episode.

Let them keep their signs If they try to enforce them
then they should have to pay all legal fees
and pay a big fine :boxing
