Halloween...

So, being the wise guy that I am, I'm wondering if it would be legal to dress up as a cowboy/soldier/cop/whathaveyou for halloween and openly carry a real gun? I mean, technically isn't the legal definition of concealed something like "a casual observer wouldn't know it's a gun"? Because I bet most everyone would think it's just a toy or prop.

Note that I'm not asking if it's a good idea (because it most certainly isn't), just if it'd be legal or not.

I'm going to go way out on that limb and say, NO. It would not be legal. Well, maybe not that far out on the limb.

Nope. Not legal. Could you get away with it? Maybe if the only people who saw it were ignorant of what is a real gun and what isn't. Really ignorant. :biggrinjester:

I'm amazed at this tradition of flinging your door open every time the bell dings not knowing if it is trick or treaters or a home invasion.

It is still illegal to open carry a handgun in Texas, even if it is Halloween.

If it is a CHL holder, that is intentional failure to conceal.

If a person is unlicensed, a handgun is Unlawful Carrying of Weapons, regardless whether it is loaded or unloaded.

Under cover of darkness (nightime) you can shoot trespassers, yes?

You don't have to conceal a lever action rifle or AR-15, so that's one way to openly carry a real gun as part of your costume.

I don't think it's just limited to those two types of rifles. As far as I know, one can open carry any rifle, just as long as it's not done to scare people (I don't remember the exact wording, but as far as I know that's the essence of it).

This means you couldn't carry a rifle as a part of a Halloween costume because the purpose of Halloween costumes are to scare people.

It takes less than a minute to look it up if you don't remember.

That's scary, the fact that big bird is the most popular costume is scary ...especially if you spot someone in a big bird costume at the voting locations. It could be a scary political statement
