Executive orders prohibited in Obamacare

I started a new thread to avoid hijacking another post. I watched a video posted from the NYC debate on the new gun legislation and heard something very interesting about 3:00 minutes into the video. According to Obamacare senate amendment 3276 section 2716 part C, the federal government is prohibited from collecting any information related to the lawful ownership or possesion of firearms. Can anyone verify this? If so, the recent executive orders are in direct conflict with Obamacare by creating national databases to collect information. Why has this not been pointed out by the pro 2A groups? Is this just another case of sign the bill so we can find out what is included and nobody knows exactly what it contained including Obama? Can't legislate law and create orders that conflict. I would like your opinions.

What it says is that doctors MAY not be required to collect such info. It doesn't say that they CAN not. I'll find the relevant section when I get home and post it for you. Unless someone else beats me to it.

(5) LIMITATION ON DATA COLLECTION REQUIREMENTS FOR INDIVIDUALS- No individual shall be required to disclose any information under any data collection activity authorized under the Patient Protection and Affordable Care Act or an amendment made by that Act relating to–`(A) the lawful ownership or possession of a firearm or ammunition; or`(B) the lawful use, possession, or storage of a firearm or ammunition.’.

it covers the doc asking about any firearms in your home
the standard answer to your doc if they ask is . how does that information directly affect my health or this visit?
point of interest is my new doc, has a form the nurse has to check off. mind you this office is directly under the ETMC hospital system and for us provides excellent care and availability
but the form asks if you feel safe at home. thats it about your home


my doc has told me she was given guidance about firearms and they are not going to ask either way unless you state your depressed or having some severe mental stress while at the office.
she is a pro 2A, and enjoys skeet shooting :woohoo . but i still will deny any answers about firearms in my home.
my phys therapy office, also is very pro 2a, and we chat about skeet shooting and plinking almost every visit, and I have shot with her at the range often
she even encourages reloading as part of the rebuild therapy for my arm and hand and eye coordination

i guess in my county we are lucky as most here are a "back off big brother" from overbearingness (new word)


that being said
my VA doctors ask every visit if i have firearms in my home and each time i choose to answer n/a , so i am sure they know we have firearms.
then wouldnt you know that weds night i sliced my left thumb joint with a razor knife, not a small baby cut but over 1" deep and netted 6 stitches, ER doc asked how it happened and if i felt safe at home :smilelol5:
she knows me and tends to see me about 3 times a year at the ER and very often at the range

First, stop calling it an 'Executive Order'.

The lefties have rename this to give it a more friendly and fuzzy name.

Originally it was a Presidential Order

Changed last week to Executive Order.

Changed Monday of this week to Executive Action.

Sure would not want to take a lefty to the range. The target keeps moving.

There is also this in the Obamacare act:
"(c) PROTECTION OF SECOND AMENDMENT GUN RIGHTS.—[As added by section 10101(e)(2)]
‘‘(1) WELLNESS AND PREVENTION PROGRAMS.—A wellness and health promotion activity implemented under subsection (a)(1)(D) may not require the disclosure or collection of any information relating to—
‘‘(A) the presence or storage of a lawfully-possessed firearm or ammunition in the residence or on the property of an individual; or
‘‘(B) the lawful use, possession, or storage of a firearm or ammunition by an individual.

So I'm just back from the Doctor. Annual physical. True story.

Doc is doing his thing, checking ears, throat, etc when out of the clear blue he says....

"Obama says I'm supposed to ask you about guns in the house, but since this is Texas, we know everyone in Texas has a gun. It's a requirement before you can get your drivers license. But, if you DON'T have a gun and need me to write you a prescription for one, just let me know."

To which I said... "Do you think my pharmacy plan will cover it?"

And the Doc said... "Maybe they'll cover it if it's a generic."

OK, I might be willing to drive up from Houston to visit your doc if he's on my plan ;)

Oh wait, I already do make that drive every six months to visit my Dentist in Richardson (old family friend).

What does the law have to do with anything any more? Our rulers aren't subject to the law. Obama and Holder openly disregard any law that gets in their way.

I thought ObamaCare says Doctors are not PROHIBITED from asking you, but that you are also under no obligation to answer if they do.
Am I confused?
