Currently, law enforcement agencies cannot perform a NICS check when transferring, returning or selling weapons that have been confiscated, seized or recovered. The new rules would change that, allowing officials to perform a background check on people who receive those weapons to ensure that they are permitted to own a gun.

I wonder if this would mean that in an LEO contact, if the officer takes your handgun temporarily, they will have to perform a NICS check before they can return it.

Why wouldn't the CHL serve as a background check, the same as it does when purchasing a gun from a retailer??

It means they can perform it. I dont' think it requires it. I would think that as soon as law abiding CHLs started having their guns confiscated pending a NICS check......which qualification they already exceed by virtue of having the CHL.....I think enough Texans would be up in arms to make this a politically non-viable tactic for chief LEOs who face reelection.

What concerns me more is whether or not any of these rules will negate Texas's law which says that CHLs don't have to stand around and wait for a NICS approval when purchasing a new gun.
