OK, lets see if I've got this right. SB299 passed the Senate with a vote of 28-2 and the House with 140-9. So this bill should be ready for the Governor. Will we need to wait until 1 Sept. or did it receive enough votes to be become effective when signed? Am I missing something?

Section 39, Article III, Texas Constitution, provides that “No law passed by the Legislature, except the general appropriation act, shall take effect or go into force until ninety days after the adjournment of the session at which it was enacted, unless the Legislature shall, by a vote of two-thirds of all the members elected to each House, otherwise direct.” If an act does not specify an effective date, the act becomes effective on the 91st day after the date of final adjournment.

last sentence, it takes effect 1 Sept. I doubt it got enough votes to take effect immediately.

So is this one headed to Rick's desk?

Also, would this bill necessitate a change in educating CHL's with display in regards to use of force?

I would hope it would, as we would now have much more leeway.

While this is a great bill and gives us a defense to prosecution if you pull your gun where only force is necessary, I personally will still teach individuals that they should not pull a gun out to 'scare someone off' because the threat of force was presented but not to a level they felt they were in fear of serious bodily injury.

The big advantage of this change is we will potentially have a little more advanced legal ability to present a firearm if we feel the situation is escalating rapidly to the point it will be needed.

Really? To me, it sounds like it helps to avoid situations of unintentional failure to conceal a little better, like with Handog's situation.
