Elgin, TX: Jewelry store GG uses shotgun, kills BG.

Elgin is 19 miles east of Austin, along US 290. It is located in both Bastrop and Travis Counties.

Was the GG fully within his rights to shoot at the women in the getaway truck?

I don't know the answer to the question, but I would not have taken the shot at the fleeing truck. It should be noted however that even while fleeing they were still in the process of committing a felony. If fact they may be charged with some degree of murder as a person died as a direct result of their crime.

i definitely wouldn't have shot at the getaway vehicle, just try to get a license plate and a vehicle description. i do agree though the getaway driver/passengers should be charged as accessories to the crime the BG was shot over, and charged with his death too.

While I wouldn't have shot at the getaway vehicle, since it happened at 1 AM, he was probably acting within the law. And there is one less dirt bag on the loose.

KXAN's report says authorities say dead guy was involved in a burglary of the same store less that 2 weeks prior. Like most, I think the store owner is clear in shooting the guy inside the store. I don't think I would run outside and shoot the truck. I hope he doesn't get in trouble for that, but who knows. The women definitely are responsible since they were apparently involved. I know in Texas, if you're part of a unlawful act that and someone dies, you're charged with murder too, however I'm not so sure when the dead guy is your accomplice. I've seen that happen in other states.

Another interesting question is why was they owner at the store at 1am? Doing inventory? Does he have living quarters in the back? Or, could he have been staking out the place in case someone tried to break in again? There's so many ways for the good guy to get screwed in this, and that's sad. He must live with his actions - even if he was in the right, and that's a heavy burden.

His store. I don't think he needs a reason to be there at 1AM. I've been in my office at 1AM in the past.
