Maybe not quite yet. A(n) (unidentified) judge on the 9th Circuit Court has asked for the Peruta case to be reheard en banc, so the Court has called on the parties involved to give briefs on whether this should happen or not.

That's how the liberals roll. As I recall though, the 9th Circuit is the most overturned circuit court in the nation when cases end up in SCOTUS.
