Gun Stolen from GFZ Hotel Parking Lot

Why would someone stay at a hotel they couldn't take their gun in and leave it unsecured in their vehicle? Cause they got a good deal on a room on the riverwalk? Hope it was worth it.

There's a pretty good case that you are not violating 30.06 by carrying a handgun into the hotel from your car to your room. That's because you don't need an LTC to carry from your car to premises under your control. The hotel room (for the duration that you rent it) would seem to be "premises under your control".

Additionally, you don't need an LTC if "traveling". Much has been made of the fact that there's no definition of traveling. At the end of the day the prosecution has to prove...in court...beyond a reasonable doubt...that you were NOT traveling, to give you your $200 ticket. Staying in a hotel away from your home, would seem to be (by any reasonable definition)...traveling.

So if I were faced with a similar situation, I would CC the gun to my hotel room. OK now before everybody starts screaming at me for violating FORUM RULE 4.... I am NOT promoting illegal conduct. I am promoting conduct that is entirely legal (or certainly hasn't definitively been proven not to be).

Texas law requires that any policy prohibiting a guest’s right to bring firearms onto a hotel premises be disclosed in the terms and conditions of guest reservations on the hotel’s website at the time a reservation is made. Under Texas Occupations Code § 2155.103 (2015), if a guest makes a reservation by phone, the hotel’s written confirmation of the reservation must include information about how guests may access and review the applicable gun policy.

If you elect to go to a posted hotel you take your chance. They must notify you as per above.

If they don't notify you and they are posted can you still be convicted for 30.06 violation (assuming it applies)?

Not at all, I agree with you....this time.

Concealed is concealed. We much prefer to travel in our modest RV; however, we would never leave anything of value in our vehicle in a hotel/motel parking lot OR in the unattended room. Y'all do it your way, we'll do it our way, eh?

That Hyatt in the story is listed as posted on texas3006.com. Maybe OP thought that might be the reason for leaving the gun in the car. I believe there's a valid argument that MPA or 'traveling' exemption may apply, but don't want to suggest anybody be the "test case".

I saw this on the news and checked 3006.com and saw they, Hyatt, are posted so figured that was why she left her gun in her truck. She may make a habit of doing this.
