There's not a lot of info in the story. It sounds like he might have been a little quick to shoot, be we haven't actually heard his side of the story .... like, did she behave threateningly toward him, etc? Personally, I'm not sure that I would shoot someone wandering around in my backyard, as long as they weren't being threatening or violent against me. I just don't know enough about the situation to have an opinion. The story does not mention the homeowner being charged with anything, so the police evidently thought he had reason enough within the law to shoot. Like TVGuy said, we shall see.

I think by charging her with criminal mischief they are protecting the homeowner.

Criminal Mischief during the night time...
The one misdemeanor that is allowed the use of deadly force to stop, in Texas.

There is mention of an AC unit being damaged. I'm guessing that is the source of the criminal mischief charge. It will be interesting to read more facts once they come out. Too little to go on here.

I have a friend in north Ft Worth that had two strangers knock on the door this morning at 6am. They were holding a phone and said they were at the wrong house when my friend demanded to know what they wanted. The strangers were covered in dark hoodies.
I get the impression that opportunistic burglars were looking for an easy target. Forgive my cynicism, but I don't trust strangers in the dark.

The title of this thread is severely misleading.
The news article says witnesses said she looked "suspicious". But nowhere in the article does it say that she was shot for "being suspicious".
I think the news article is written decently for most likely the information they had at the time.

Police say a homeowner thought the woman he shot was trying to break in, and opened fire. Investigators say the victim had been arguing with a neighbor shortly before the shooting, but they have not said why she was on the homeowner’s property. The wounded victim is recovering in a hospital, and has been charged with criminal mischief. The homeowner is not facing charges at this time.
And another:

Police got a call about 2:30 a.m. saying a female suspect was banging on and trying to open the window of a home in the 2500 block of North Edgewood Terrace. The homeowner shot the woman in the back yard, said officer Brad Perez, police spokesman.

Assuming the back yard was fenced, that put the woman in an enclosed space functionally (although probably not legally). While I don't know that I would pull the trigger in that case, I see how that adds a higher element of threat. Inside a fenced back yard is different than an open front yard. However, once you add attempted forced entry, that elevates it to something else entirely.

This is another one where I wonder about the (shooting) victim's blood alcohol level.
The homeowner shot the woman in the back yard
So I guess she's going to be taking her meals standing for a while ....

sigh, another shining example of the media not using proper grammar....
(for those who are a little slow, reference the Groucho Marx routine about "I once shot an elephant in my pajamas.......")

That's more than suspicious. You might even say she was "attempting to enter unlawfully and with force, the actor's occupied habitation"
