Applying for FFL in Austin, TX

I am getting ready to send off my paperwork for my FFL 07. I have struggled with the city and decided for an 07 since I am not zoned to have customers technically, so I figured manufacturing would be the easier way to go.

Does anyone have an experience with this?

Also, will the ATF IOI be contacting the City?

ATF will check all zoning or HOA issues. If your business goes against any without written evidence to the contrary (waiver, letter of authorization, whatever), you won't get an FFL. They'll still come talk to you though and explain why you're not getting one.

So I am not zoned for equipment sales or retail however manufacturing is fine. I applied for an 07 and got an email from the city saying that my firearm business was fine as long as I follow the rules of the home occupation regulations. My concern is that the IOI will call the city and the city will say, no you can’t have retail customers, and that will be that.

I want the opportunity to say that I am planning on buying parts and assembling them for online sales, with the occasional transfer.

Do you think that letter from the city will suffice?

Have a letter from your HOA stating they know what you plan on doing and they agree. I would have a letter from the city stating the same thing as well as references to the local ordinances so you can prove you aren’t violating anything. My initial IOI didn’t check either, the next IOI called my HOA and asked them if they knew what I was doing and if it violated HOA rules. He also called the city and asked about home based businesses. Just have your ducks in a row and you’ll be fine but check city and county ordinances to make sure there are no surprises.

That’s not necessarily true, they are supposed to but you never know what type of IOI you will get. My first one was more concerned with making it back into Houston before traffic got bad and checked neither one.

ATF really started cracking down on zoning issues about 5 or 6 years ago. Right about the same time a lot of distributors started cutting out table-top FFLs.

What we were told was they're doing those checks before they ever come do the in person interview. We moved locations, but because we had a 30 day gap between new location and old, were forced to get a new FFL. It was stupid, but did allow us to start with a clean sheet at the new location.

But like you said, IOIs are notoriously inconsistent.

Ok so this is what I got from the city:

"There are no permitting requirements for operating a home-based business in the City of Austin, provided the business complies with the Home Occupation Regulations found in Section 25-2-900 of the City of Austin Land Development Code, accessible here: https://library.municode.com/tx/austin/ ... -2-900HOOC and included below. A firearms-related business that conforms with these regulations is permissible within the City of Austin."

From the HOA I got a letter that says:

"The Avery Ranch HOA has no objection with you using your home address from your Federal Firearms License"


Do you think that will be good enough?
