Don’t have my FFL nor SOT, however I have looked into what it takes to manufacture and/or acquire post sample machine guns and be able to acquire without a year long wait for a stamp. First off I believe it is about 500 a year, and that must be maintained yearly or the ATF will confiscate all NFA items without a regular folks tax stamp. The second issue is you must have a business and be able to prove business. The third issue is getting a letter from law enforcement allowing you to manufacture or acquire post sample machine guns for “demo” purposes. You had me crackin up! You're right no doubt about it, Scenerio 2 would definitely happen. Bad idea but you must admit would be "tacti-coool".So how are dealer samples exempt from ATF regs? NFA handbook section 479.105 (d) states an application must be made and approved if you have a letter from a governmental entity expressing a need for that model. Well technically they are registered when you manufacture them (send in your Form 2). It's a closed loop though. They're not registrable and the potential customer pool is tiny to non-existent. Rentals can work if you have a good range setup. T&E is fun for a little bit, but your ammo budget suffers.
Yes, technically you're correct.
