That's a good question. Until you have seen the sign, you have not been given notice. Once you do, then you must assume the whole building is off limits until you can verify if it is just a specific area or whole building. Businesses can define only a portion of the building on the license. While I am not a TABC expert, my understanding is the area is usually defined as the places they can take alcohol to and from. So, in this case, if they restrict the consumption of alcohol they sell to the restaurant area, then the signs may be placed correctly and that is the only area off-limits. If the whole building is defined, they need to post the signs on the entrances. I would think they hold banquets and do special showings and allow alcohol to be consumed in areas other than the restaurant, so my guess is whole building is defined. The only way to know for sure is to call the TABC local office and inquire if it is the whole building or not. If the whole building, then TABC can and will make sure they locate their signs per regulations. And, they can also go back and question the vendor about the percentages again if there is question that they really make that much from alcohol sales.TacShot wrote:Refresh my memory please, does that make the entire building or just the restaurant off limits to a CHL. There is a non-compliant (30.06) notice on the entrance (the "rear" entrance... the only one in use because the main entrance is closed for the expansion construction.)
I had seen that sign before so, even though it was non-compliant, I was not carrying. We had lunch there and the restaurant area had the 51% signs at the hostess desk and along the serving line. They do sell wine there with their lunch menu.
Bottom line, once you see the sign and have notice, you best back out of the building and not carry until you know for sure where you are and are not legal.
