Like is so often said here, except by the lawyers on the board, "I am not a lawyer". Having said that, I think a jury is sometimes given limited choices to choose from. I am not sure what happened here, but it may have been a case of let him walk or find him guilty of first degree. I could be wrong, and it would not be the first time today, so the more edumacated amongst us can correct as warranted.

It really gets my blood boilingthinking about this case and then to see that the Loughner scum bag in Arizona is “incompetent to stand trial”, Give me a break!
and I also agree with TAM. I have no doubt the adrenaline was on full-pump with this guy, and he was probably TRIM (The Really Irritated Man). Shame he had to fire the extra shots. When I saw that video, I thought to myself, "He just screwed himself".
