Need to pick yalls brains
I've got a Helper I sold a handgun to a few months ago. Now he is going though a divorce and so he asked if I would hang on to the gun. He didn't want any trouble from his wife’s lawyer. And he would get it back after the divorce was over.
Well today he called and said that he told his lawyer that he sold the gun to me. Now the lawyer wants to see a copy of the bill of sale. So my helper asked me to make a bill of sale for him.
I don’t feel right about these. What do yall think about it???????

Sounds to me like the gun is somehow tied to the divorce, Did he pull it on her at some time and then get rid of it by giving it to you and then lying about selling it? Just saying.........
DO NOT MAKE A RECEIPT. There is no requirement in Texas to provide a bill of sale between two individuals who are residents of the State. The Lawyer is fishing and has no clue about firearm transfers in Texas. Give the gun back to him and let him figure out what to do with it and how to cover his lying......

Every item of worth is going to be itemized and divided between them in the divorce. If he's selling something of worth to keep her from getting it (major no no), the judge has to decide whose property it was and how much each gets from the sale. The wife would probably get half the amount of the gun (exceptions apply) even if there's nothing shady.
Interesting that he said he didn't want trouble from his wife's lawyer. Maybe he doesn't want to appear violent or capable of violence by having a gun in his name? Maybe that's why the lawyer wants a bill of sale to prove he doesn't own it any longer?
In any case, it seems to me that your gut is saying red flags and something isn't right and you don't feel comfortable with this. Go with your gut.

And if pushed for a bill of sale, just tell them that in Texas, there is no requirement for a bill of sale on a weapon - and this is NOT a lie, as long as he didn't ask if you bought it

Make a reciept. Date it for tomorrow. Pay him about a third of what it is worth. You have your gun, he has a reciept. He can buy it back at full price later to thank you.

When it comes to guns the only person I lie to is the wife and that's about what I paid. But seriously I'd be out on that deal no matter how good of a friend and if he doesn't see it that way then oh well.

As everyone has already pointed out, there are a host of problems with this whole scenario. Here's one more...
When there IS a bill of sale, isn't it usually the seller who prepares it and the buyer just signs? I wouldn't sign one for him either. This whole thing smells like fraud.

Way too many alarm bells on this one....I'd just take it to the lawyer's office (disassembled, just in case) and give it to him....with a witness watching the entire exchange, of course....

Ok... side note... but funny. (and yes, it's true)
I clicked that link and was reading all the information DIVORCE, and guess who walks in??
So, I am now having to explain to my wife why I was interested in that link.
(It didn't help that the link has the image of the fighting couple and of the MAD WOMAN. I don't think women even need to *see* those images. They can just smell 'em.)
I don't suggest falsifying this transaction with your friend, but now I need you to send a note to my wife explaining that I'm perfectly happy and don't plan on filing for divorce.
PS. If I now get divorced as a result of this thread, I will need you to hold onto a few guns for me. Thanks.
