Municipal Judge Rules For Carrying

Post by RossA »

I know that there are some special rules for judges carrying, but I haven't received a call from any of them before. A local municipal judge called and asked me what he has to do to be allowed to carry, not pursuant to a regular CHL, but under special rules for judges. Told him I would have to do some checking, since my students are regular CHL candidates.
Does he submit special paperwork, still take the range proficiency, or what?
What part of the process do I get involved in?
Thanks in advance.

The danger gone, the trouble righted,
God's forgotten, the soldier slighted.

Go to your CHL 16 and you can find the answer in GC §411.201. ACTIVE AND RETIRED JUDICIAL OFFICERS

https://www.txdps.state.tx.us/internetf ... CHL-16.pdf" onclick="window.open(this.href);return false;

He will still have to get a CHL, just doesn't have to go through the class but has to meet some specific guidelines and show proof of handgun proficiency.

I can sorta see why they wouldn't have to go through the class, but I wonder what about being a judge would exclude them from having to complete the shooting qualification portion.

It doesn't. They have to show proof of proficiency.

So if I read the GC correctly, he has to apply as a regular CHL applicant, has to take the proficiency test, and an abbreviated classroom portion, but only on certain subjects. Also, there is no time requirement on how long the classroom portion must be, and apparently no written exam, right?
So as a practical matter, how does he apply? Does he go online as a regular applicant, fill out the forms, and there is someplace for him to check that he is applying as an active judge?
Do I fill out a regular CHL-100 for him after the short class and the range test?
If I need to say that I gave him the classroom portion, how do I indicate that he is a judicial officer and didn't need to pass the test? I just looked at a CHL-100 and there is no place to indicate that he is a judge.
Thanks again.

The form is NOT a CHL-100. It is a form defined by the department (DPS). I would suggest you contact DPS and ask them what form to submit and what is needed in the affidavits for a municipal court judge to get a CHL.

Well, in the past I have been noticeably unsuccessful about getting DPS on the phone for an answer, but I'll try again.
Has anyone on here actually helped a judge get a CHL? Can anyone at least give the the name or number of the forms to use?
Just trying to help somebody do things legally.

Judges and district and county prosecutors are not required to take the proficiency course, provided they submit a sworn statement from a TCLEOSE -certified handgun instructor certifying that they have demonstrated handgun proficiency to the instructor within the previous twelve months. http://www.texaschl.us/faq.htm#officers" onclick="window.open(this.href);return false;
