My only interest is my personal 30.06 or .07 notification. Have I or have I not been legally notified that I may not exercise my right to carry my weapon? Their policies are not a part of that...their intent is not a part of that...what they think is best for their customers is not a part of the law.

I don't even stop shopping there as a result of their policy. My purpose is not to train them. My purpose is to shop where it pleases me at the time and place of MY choosing until I have been properly notified as prescribed by law.

Once notified I am happy and legally bound to comply. THEN I will stop shopping there because their location is dangerous to be in due to the fact that they have put big signs up outside telling all criminals that everyone inside is disarmed and unable to defend themselves.

And I'll write letters to the appropriate levels of management telling them why they have lost my business.

The only corporate policy that I care about (aside from my employer) is Costco. Their member's agreement does not allow guns in the store. The worst they can do is revoke my membership, since they are not posted 06/07, but if I carry openly, they could tell me verbally which would constitute effective notice. So I carry concealed and just don't make a fuss because other than their weapons policy, I LIKE Costco. The prices are great, the products are great, and the employees are friendly and well treated. Costco is my only exception to the "no guns = no money" rule, and they are the only corporate policy dictated gun-free zone that I pay the slightest bit of attention to. I actually carry openly in the Lubbock Target every time I go. Maybe you'll see me sometime SIRIT. :lol:

...Costco or any other membership only organization. A membership agreement binds one to the requirements of the agreement that you freely agreed to abide. As to whether or not that policy, in the case of guns, has to be in the 30.06/.07 format is not clear to me. My guess is that it does not since this is a private membership contract.

It only binds you civilly, as the law is quite clear how criminal trespass notice must be conveyed. And Costco doesn't do it. So I suppose they could file a civil suit against you for violating your membership agreement, but practically what damages are they going to claim?

Violating a contract is rarely, if ever, a criminal matter so why make a production out of it?I I guess if you feel like you are violating your word by signing an agreement that you don't intend to strictly observe... On the other hand private membership warehouses were created to get around blatantly rigged minimum mark up laws and franchise laws in states that were designed to legally screw the consumer. :banghead:

I'll give it the same amount of attention that I'm going give to topping off my Hertz car within 1 mile of LAX tomorrow as I agreed in my master rental agreement. :rules:

I don't know that's true. If I stipulate in a contract where you may go within the building as a privilege of membership and you violate that I believe you would be trespassing.

It may be true that that stipulation as it relates to CC or OC even in a contract must still be in 30.06/.07 format.

I don't think so because we're talking two different things. One is Costco's right to restrict you in whatever way they wish as a term of membership. That restriction can be anything. For example... They might require that guns can only be carried in the store if they are 9mm only, and only glock. All others are prohibited. As a member you agree to that term. Let's say you subsequently don't. They can kick you out of their store. And if you refuse you are trespassing.

As a non member patron they only have one choice of restriction, that being 30.06/.07. So they would have to accept my gun or not, but could not discriminate between a 9 and a 40.

So I think trespassing is trespassing for whatever reason the owner stipulates. The law only states that when the only reason for the exclusion to one's property is the carriage of a handgun then the only way to notify of that trespassing restriction is by 30.06/.07.

The question to ask for criminal prosecution is...what is the State going to charge me with? A contract can restrict you from carrying a 9mm or gun at all. But a violation of this contract is not a criminal offense. Trespass under 30.05 and 30.06/7 have explicit requirements for notice and they are not met by a written notice unless they use the specific language for 30.06/7 relating to handguns. The fact that Costco lets members enter the store during business hours means they have not notified you that you are trespassing by walking in armed or otherwise. 30.05 is not a general criminal sanction for violating terms of a written agreement. Hertz can't have me arrested for a class B trespass for returning a car with an empty tank, even if they put up a "no trespass with empty tank" sign (circle slash empty fuel gauge). Well maybe they'll use "shopkeeper privilege" to detain me until the cops come to arrest me for failure to refuel and DWE...driving while empty. "rlol"

since i no longer work for a corporation, their policy doesnt effect me. Posting of legal signs affect me..

That's just the TABC sign - any store that sells alcohol for off-site consumption has that sign. Doesn't apply to LTC/CHL. :cheers2:

There was another TABC sign on the next door in. This one seemed to have odd wording as well... Maybe I'm just being nit picky, but at any rate, the sign didn’t matter to me at all.
