The signs are up at Chase Oaks Village
Came home to find legal 30.06 and 30.07 sign on the gates at Thornburuy at Chase Oaks apartments in Plano. This is the place that issued the lease addendum saying carry to and from the car was grounds for eviction.

Re: The signs are up at Chase Oaks Village
That sucks. Are you in a lease or just month to month?
Re: The signs are up at Chase Oaks Village
30.06 doesn't apply to and from your vehicle.
If you're already on an existing lease, they can't force you to sign the addendum until you renew your lease.
Might be time to plan your next move. When you leave, make sure to tell them why.

Keep calm and carry.

Would 30.07 even apply to and from the car?
We are stuck here until September.

I don't know to tell you the truth. I would imagine it would since its their property but hopefully one of the more seasoned members will chime in.B23Msports wrote:Would 30.07 even apply to and from the car?

Re: The signs are up at Chase Oaks Village
I am not going to OC just to find out, just wondering how that works.
Now how about taking out the trash? I have to pass by the dumpster to get to my car, so I usually take the trash with me. I know there have been posts talking about community areas and such that would make going to the dumpster a no-go, but I am going to the car as allowed and tossing some trash out along the way. Not trying to be picky or stirring it up, just a thought.

Sounds like Chase Oaks is thoroughly convinced their complex is absolutely safe and no threats to the safety of their tenants exists other than LTC holders.

I am preparing an email right now saying that same thing. I will post the response - if I get one.puma guy wrote:Sounds like Chase Oaks is thoroughly convinced their complex is absolutely safe and no threats to the safety of their tenants exists other than LTC holders.![]()

Sounds like a great reason to stop renting and look for a house to buy.

in a NON home owners association restricted area where the HOA can't tell you what color to paint your house, what kind of grass to plant and if you can have a flag, or if you can have more than one car or if your trash can is out... so on and so forthBulldogBorders wrote:Sounds like a great reason to stop renting and look for a house to buy.

You might check with a lawyer that deals in leases, just to see if you may have a case to break the lease. I think a ether, and or, might be present. If you sign a lease and they change things, you may be able to opt out. Depends on how the lease was written when you signed it .

Re: The signs are up at Chase Oaks Village
From what I remember, the leases are written VERY one-sided. They can basically kick you out virtually at will (and you owe them the rest of the lease's rent), but you have almost no rights whatsoever. One of the motivations that got me to buy my own home. They aren't willing to flex at all either. One time, more for kicks than anything else, I asked if I could just pay the entire lease term rent at once (no discount). I was flat out told no.
So I'm guessing the appendium probably is binding, at least in their eyes. Thus they may not be able to get you arrested, but I'm certain they can evict you, and then put black marks on your renter report, making it hard to rent anywhere else.

Re: The signs are up at Chase Oaks Village
It's a pain to evict someone in Texas. It takes a court filing and other trouble. Even for people that are deadbeats and trashing the place. The big corporate lessors probably have it as efficient as possible, but if you pay your rent I doubt thy're going to want to go to the trouble for just not signing the addendum. 30.06 doesn't apply to carrying to/from your car/residence, so you wouldn't be breaking the law by CCing to your car. If you're concealed, how is anyone from apt mgt going to notice and then run down to the county to file your eviction? Of course, you can't CC in the common areas other than on your way to/from car, and you can't open carry, but I guess you could look for a new place when lease is over if that's a large issue.
