New Form 4473 in January

Post by tk1700 »

"Question 11.e asks if the person filling out the background check is “An unlawful user of, or addicted to, marijuana” among other controlled substances. It has a new warning that points out that marijuana use remains “Unlawful under Federal law regardless of whether it has been legalized or decriminalized for medicinal or recreational purposes” under state law."

New form takes effect Jan 16, 2017. Now that the Feds position has been clarified, how many more 4473's will be completed with untruthful answers? I'm not trying to start a debate on marijuana legalization, but rather it's time to enforce the current laws or change them. What if TX had voted to allow full auto weapons? Would the Feds turn their heads the other way and see how the experiment played out?

Just another restriction, and potential chargeable offense that will be unenforceable. The only way they could prove perjury in that case would be with a drug test at the time the form is filled out.

Hopefully, with an overhaul of the BATFE, in the new administration, we will see more people actually charged for falsifying these documents, but I don't see that as being anything that will stop anyone from lying about, or smoking marijuana. JMHO.

This is obviously an Obama point and has not been done by Trump. Does that mean Obama is going to enforce current law against marijuana? A lot of states won't be happy. Trump says we need law and order.. will Trump enforce marijuana laws? Or will marijuana legality be taken off the fed books. Will be interesting. Note I do not think we need another legal intoxicant on the highways of America.

The conflict of state and federal laws on weed creates a trap for LTC holders. Eventually someone is going to prison because they had what they thought was legal weed while packing.

My answer won't change. Never smoked anything except a brisket in my entire life.
I am not and have never been a LEO. My avatar is in honor of my friend, Dallas Police Sargent Michael Smith, who was murdered along with four other officers in Dallas on 7.7.2016.

I cannot say the same. I've smoked ribs, pulled pork, and even a roast once. I've smoked burgers, steaks, and a few other meats.

Yep...just another useless Federal form. There's already been an appellate case on this in the 9th circuit (I beleive) someone with a Medical MJ card was denied purchase by a FFL. Court said this was OK because they could always buy it in a private sale.

And as a practical matter...prove it. I'm much more worried about GFSZA. "rlol"
