Small victory in Illinois: FOID ruled unconstitutional

The court ruled the FOID Act unconstitutional in regards to the licensing and taxing requirement to be in possession of a firearm or ammunition in your own home.

It may not be huge, but I’m thinking it’s not small either.

Looks like the good people of Illinois are try to sneak into the United States to be among other free people.

I can't imagine any of our founders supporting the contention that one must have a license and be taxed to exercise any of their rights under the BOR.

By definition requiring a license is and infringement on any right and only one right comes with the very specific prohibition, "shall not be infringed".

Our ancestors have over the last hundred years or so done us a terrible disservice by not fighting such laws tooth and nail every time they were proposed.

Not small. I'm not an attorney but my understanding is that the FOID has been around for decades and is the foundation for all of IL's regulations. I don't expect the IL Supreme Court will uphold it precisely for the paradigm-shattering importance that it represents. Remember, this is an OWNERSHIP license. They think that the 2A allows that level of regulation. Only a federal appellate court ruling brought CC to IL. This state has been very hostile and really still is. I'm hoping for the best but realistically think that if the SCOTUS doesn't step in after the IL SC overturns this, a victory won't be realized. I hope I'm wrong!

I lived in Illinois for 20 years before moving back to Texas, the FOID has been around a long time. This is another step to fully restoring the law abiding citizens of Illinois their 2A rights.

My grandpa's FOID card expired in 1973, so FOID has been around in Illinois for almost 50 years. I'm really glad I left that state in 1976.
