be VERY careful in apartments pre chl

So this isn't an ND story but more along the line of a negligent carry story. This might belong in the Never Again forum but I think this is strictly a newbie mistake so I post it in New To CHL. (Moderators can move around as they see fit)

For anyone that's been following my posts around here you know I don't take the class until the 11th. In the mean time I've been trying to get used to carrying the weight around. While I don't think my 5" XD will ultimately be my carry weapon that's what I have an OWB holster for so I wear that around the house.

I was just picking up and what not and then went to take the trash out. I must have gone 10 steps out my front door before I realized I was carrying unlicensed!! (Even if i was this wasn't really concealed at all) I promptly retreated back indoors and I don't think anyone saw me. Still, not how I want to be acting a week or two before my CHL class.

I feel like I should say 10 hail mary's or something

Even after you get your CHL you cannot carry openly outside your apartment (it must be concealed). The outside area of apartments are Public (not Private) areas.

Only those people who actually own the land that their accommodations are on can carry openly on their own land (if they want to).

Addendum: I'm usually very careful and concious of when I'm carrying indoors and make sure to disarm for trips outside. This time I messed up and that's what my warning nature of the posting to other newbies was about.

I don't think that's completely correct. If I leased or rented a house, I would argue the land is under my control and I'm allowed to carry there without a CHL. Another interesting twist might be condos (and some planned communities) where the common areas are owned jointly.

Neither of those apply to atxgun and his situation.

What ever the law is concerning common areas in condos I would imagine the paperwork you sign would spell out what you agree to do or not to do in respect to carrying firearms if there was any ambiguity in the underlying laws that exist.

My apartment lease for example just saying something along the lines of "not illegally possessing a firearm" since the law already says I can't carry outside of my actual apt (aside from going to my car, etc or until i get my plastic). It also says discharging a firearm is grounds for eviction too so I REALLY can't afford an ND (not to mention the likely devastating consequences of such an event in a densely populated building.)

If your going to practice carry then practice with it concealed at all times everywhere. YES even at home that way you don't make mistakes that can get you into trouble by non-gun lovers that would love to make an example out of you just because they can!

The bottom line is "on property owned or under your control".

The law does not allow for open carry in the common areas of condos. The reason is that the jointly owned areas are not under your control.

When you rent or lease a detached house, you are usually renting/leasing the land that goes with it as well. This land is under your control, so you can carry openly there.

Same thing happened to me, cept im licensed.

Walked out, phone in one hand, coat in the other, and my gun IWB, lower back.

I said hello to some guy and i know he saw my piece when i turned my back to open my car door.

I was hoping he figured i was LEO since i wear coat and tie to work :)

Apartment living can really stink sometimes. I open carry in my garage while my kids play out in front of my garage area. I keep a cover shirt nearby and have had the management walk by one time touring with a couple. They saw me in the garage and said "Oh......" and quickly, the manager turned the couple around and went into another apartment.

Kinda funny actually.
