We've got some mice/rats (they look similar to what you've got) that are pretty good sized. They are living in or at least using the landscape timbers (RR ties) in the backyard - zipping around them at night, poking their heads out - running across the back fence from my yard into neighbors' yards, etc. We have zero lot lines here so we all have to deal with them - a neighbor 2 houses down has the same issues. The local animal control officer suggested non-secondary kill bait - meaning it will kill the rat/mouse but it will NOT kill my Great Dane, neighbors' dogs, etc. if they eat the dead critter. However, the bait has to be in an area where only the mouse/rat can get it. Another option he mentioned was yellow sulfur - he said it's an eye/nose irritant - spread it at the base of the fence/timbers/holes and it will get them the heck out of there. However, if only a few folks do it then the critters will just migrate a yard over.
I like the critters, they are kind of "cute" - but the mess they leave behind and the disease potential = bye bye time.
They are HUGE fans of my Dane's left over food bits - around midnight they'll come out and take a nugget of food from his bowl and then scamper back to their hole - if we live in the country you can bet that my shotgun would be getting a workout - but I've set up glue traps - they encountered them once and didn't stick - a little mouse might have. Also had a little wooden mouse trap - they set it off and laughed at it. I should mention that I'd sit out there with my Dane (who is blissfully unaware/carefree of the critters) and have a cold beer and watch the mouse/rat theatrics (I have rope lights overhead - just enough light to see, but not too bright). I ponied up for the RAT traps - much better! Only killed one but it KILLED it! Then they wised up, so now they ignore it. I do have a baited electric-kill trap - they've ignored that one as well. Time for non secondary kill poison bait/sulphur I suppose. BTW - the officer suggested the local feed store for these items.

If you really want to kill them humanely, use a standard mouse trap. SNAP and they're dead. Don't poison them. You don't know where they will crawl off to and die or if a cat catches him and eats the poisoned mouse.

Well I guess thats one thing good you can say about rattle snakes. Where I live they do keep the rodents at bay.
