Any laws relating to OC spray and minors?

Post by Sangiovese »

I've finally decided that my daughter is mature enough to start carrying OC spray and have a question about any laws that might prohibit a minor from carrying it.

I looked through everything I could find and it seems that personal defense OC spray is specifically excluded from the the definition of "weapons" in PC46.01.

As far as I can tell, there is nothing in the law that would prohibit her from carrying it. Of course, I would hate to be wrong and get us in trouble because I didn't know the applicable law, so I thought I would ask the group if anyone is aware of any laws that pertain to this?

Thanks!

Neither am I, but I am not aware of many laws. If she is a student, I would think that some schools might classify OC spray as a weapon. That might restrict her ability to carry.

"Pepper spray" is on the list of prohibited items in the district's student code of conduct. So she won't be taking it with her to school :( Better for her to have it part time than not at all though.

I do plan to try to get a meeting with the principal to discuss the policy and try to get a letter of authorization but I honestly don't expect anything to come of it.
