church carry

Post by vickark »

I was under the impression that carry in church was prohibited. When i took my chl course
years ago i thought that was one of the places i couldn't carry.
I've seen several members on the forum that have stated that they do carry there.
Please set me straight on this issue. My wife and i visit other churches for various functions most of them at night. Some are in older parts of town (Houston) that are not as nice of an area as they once were.
Thanks

Church carry is perfectly legal unless the church posts a legally correct 30.06 sign. It's one of those points that's confusing because it used to be a prohibited place, but when they legalized it, instead of removing the bit of the law that made it illegal, they just added a paragraph at the end essentially reversing the law and making churches just like any other non-prohibited place.

Welcome to the Forum. The Church must have the 30.06 sign to be off limits. Here are few other threads.

Thanks a million guys. Wow, what a quick reply ! No doubt about it- i need to get a newer chl handbook .
It's really sad when you need to have protection just to go to church.
When i was a kid , my family would leave the house unlocked, get out of the car at church
with the keys left in it and go on in.Sometimes when we came out there would be beans, tomatoes or a mess of greens someone had left on the back seat-LOL
Thanks for setting me straight on this.

It's confusing because the way the law basically reads:

Carry is prohibited:
1 ...
2 ...
3 CHURCHES And places of worship
4 ....

Prohibitations in section 3 only apply if the property is posted 3.06.

So it's easy to think it's prohibited unless you keep reading.

Seems to me I remember a pastor or two around here who "don't leave home without it." ;-)

Vickark, you can download the latest CHL handbook here: http://www.txdps.state.tx.us/administra ... edlaws.htm.

Yes. There are three of us that I can think of off the top of my head that can be found in the pulpit every Sunday armed with our Sword (of the Spirit) and our firearm(s).

When I took my class about 4 1/2 months back (from a Detective), he mentioned Churches as being off limits, unless you are given permission. He even went further stating that if you do get permission, you should get it in writting to be covered.

As you'll see below, I've copied and pasted the the places that you can not legally carry a hand gun according to the Texas State Hand Gun Law book. I recommend reading number 6. If you don't believe me, go to this link and scroll down to page number 40: http://www.txdps.state.tx.us/ftp/forms/ls-16.pdf

You forgot one important section:

(i) Subsections (b)(4), (b)(5), (b)(6), and (c) do not apply if the actor was not given effective notice under Section 30.06.

You can find it immediately under the section you provided the link to.

It seems most people stop reading before they get to clause (i). Don't beat yourself up over it.
