SCOTUS Expands Stop And Frisk By Police

In an opinion so spare that the Supreme Court did not labor long to produce it, the Justices on January 26 unanimously expanded the control that police can exercise at the scene of roadside traffic stops. The ruling brought an enlargement of “stop and frisk” authority.

The Court removed the traditional Terry Stop necessity for police to believe a crime is in progress before a frisk, but did not vacate the requirement officers must have reasonable suspicion that suspects are armed and dangerous to conduct a search.
